<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
<br /> SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT
<br /> ORDINANCE WHICH REGULATES AND RESTRICTS THE LO-
<br /> CATION AND USE OF BUILDINGS, STRUCTURES AND LAND,
<br /> DATED SEPTEMBER 29, 1980 (VOL. 54) BY ZONING 1. 02
<br /> ACRES OF LAND, MORE OR LESS, OUT OF THE J. M. VERA-
<br /> MENDI LEAGUE NO. TWO, IN THE CITY OF SAN MARCOS,
<br /> HAYS COUNTY, TEXAS, A/K/A 1207 RIVER ROAD, FROM
<br /> IIAO" (AGRICULTURAL-OPEN SPACE DISTRICT) TO "c"
<br /> (COMMERCIAL DISTRICT).
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br /> SECTION 1. That the following described parcel of real property 10-
<br /> cated in San Marcos, Hays County, Texas, which was classified IIAO"
<br /> (Agricultural-Open Space District) upon its annexation to the City
<br /> of San Marcos on November 24, 1980, henceforth shall be zoned as
<br /> follows:
<br /> 1. 02 acres of land, more or less, out of the J. M. Veramendi League
<br /> No. Two in the City of San Marcos, Hays County, Texas, being a portion
<br /> of that 5.00 acre tract of land conveyed to L. O. Backus by Quad Thea-
<br /> tre Company by Deed dated January 10, 1979, and recorded in Volume 321,
<br /> Page 95, Hays County Deed Records, and being more particularly described
<br /> by metes and bounds as follows, to-wit:
<br /> BEGINNING at the East corner of the said Backus 5.00 acre tract, for
<br /> the East corner of the tract herein described, same being on the North-
<br /> west side of a County Road No. 299 ( River Road);
<br /> THENCE, with the Northwest side of the said County Road No. 299 (River
<br /> Road), the Southeast line of the said Backus 5.00 acre tract, S. 45° 00'
<br /> VJ., 30.03 feet to the most Southerly Southeast corner of the tract here-
<br /> in described;
<br /> THENCE, leaving the said County Road No. 299 (River Road), N. 47° 25' W.,
<br /> 330.0 feet to a re-entrant corner of the tract herein described;
<br /> THENCE, S. 45° 00' W., 102.09 feet to the most Westerly Southwest corner
<br /> of the tract herein described;
<br /> THENCE, N. 47° 25' W., 330.0 feet to the Northwest line of the said
<br /> Backus 5.00 acre tract, for the West corner of the tract herein described;
<br /> THENCE, with the Northwest line of the said Backus 5.00 acre tract, N.
<br /> 45° 00' E., 132.12 feet to the North corner of the said Backus 5.00
<br /> acre tract, for the North corner of the tract herein described;
<br /> THENCE, with the Northeast line of the said Backus 5.00 acre tract,
<br /> S. 47° 25' E., 660.0 feet to the POINT OF BEGINNING, containing 1.02
<br /> acres of land, more or less. Field note description prepared April,
<br /> 1983, from Public Records, calculations and surveys in October, 1978,
<br /> by Raymond Dietert, R.P.S. No. 1868, as prepared by Kelly Kilber,
<br /> Registered Public Surveyor #2219, a/k/a 1207 River Road, to be zoned
<br /> IIC" (Commercial District).
<br /> SECTION 2. That this Ordinance shall be in full force and effect ten
<br /> (10) days from and after passage and publication in a newspaper of
<br /> general circulation in the area.
