<br /> -2- <br /> III. <br /> Sadowsky agrees to keep adequate books and records and to <br /> furnish certified statements of total gross receipts derived from <br /> advertising on said benches upon reasonable request of City. <br /> IV. <br /> Sadowsky agrees to maintain benches within the City <br /> of San Marcos at the locations shown on the attached Exhibit A, <br /> incorporated herein for all purposes. Should Sadowsky wish to <br /> add any location to or to delete any location from this Contract, <br /> Sadowsky shall deliver to the Chief of Police an amended <br /> Map seven (7) days prior to the date on which said addition or deletion <br /> is proposed to become effective. Within said seven (7) day period, <br /> the Chief of Police for the City of San Marcos shall give written <br /> approval or disapproval or shall request in writing further time <br /> for consideration of said amendment. Should the Chief of Police <br /> take no action within said seven ( 7) day period, Sadowsky may proceed <br /> with the proposed amendment. Nothwithstanding any other provision <br /> of this Contract Sadowsky, agrees upon written request of City or <br /> adjacent property owners, to remove or relocate any bench. <br /> V. <br /> Sadowsky agrees that said benches shall be substantially, <br /> durably and attractively constructed of concrete and wood and/or <br /> plastic secured by bolts in a safe manner, subject to prior approval <br /> of City. Such benches shall be maintained by Sadowsky in such a <br /> condition that they will not constitute a hazard to the safety and <br /> well being of any person or constitute an impediment to vehicular <br /> traffic. Grass growing adjacent to or under benches shall be neatly <br /> trimmed. <br />
