<br /> -4- <br /> benches, and shall defend any litigation arising in connection <br /> with such construction, placement, or maintenance including <br /> reasonable attorneys' fees whenever said damages, claims, losses, <br /> demands, suits, judgments, costs or expenses are caused in whole <br /> or in part by any negligent act or omission of Sadowsky, anyone <br /> directly or indirectly employed by Sadowsky or anyone for whose <br /> acts Sadowsky may be liable regardless of whether said damages, <br /> claims, losses, demands, suits, judgments, costs or expenses are <br /> caused in part by City. <br /> X. <br /> Sadowsky agrees to file with the City a policy of public <br /> liability insurance issued by a casualty insurance company duly <br /> authorized to do business in the State of Texas to the minimum <br /> limit of $100,000.00 per person and $300,000.00 for any single <br /> occurrence for bodily injury or death and $100,000.00 for any <br /> single occurrence for injury to or destruction of property. Said <br /> insurance policy shall name City as co-insured. Said insurance <br /> shall contain the endorsement that such insurance may not be <br /> cancelled or amended with respect to Sadowsky without ten (10) <br /> days written notice by certified mail, return receipt requested, to <br /> City by the insurance company. City shall not be required to pay <br /> any of the premiums for said policy. Any insurance policy herein <br /> required or procured by Sadowsky shall contain an express waiver <br /> of any rights of subrogation by the insurance company against City. <br /> A copy of said policy shall be delivered by Sadowsky to City within <br /> (10) days of the inception of such policy by the insurance company. <br /> The minimum limits of any insurance coverage herein required shall <br /> not limit Sadowsky's liability under Part IX of this Contract. <br />
