(" DAY MORATORIUM ON THE PROCESSING OF APPLICAl(J) ~ f:""'I , "[Or- () (iJ TIONS FOR SPECIFIC USE PERMITS AND CONDITIO~T2 .þ.. 0.:. ~,=-: i ,IJ eJ) USE PERMITS FOR ESTABLISHMENTS DESIRING TO <:D Q.. f::I:j -;-=,~; fu J) ";,q DISPENSE ALCOHOLIC BEVERAGES WITHIN THAT A~ ~ æ 0 t:1 >""'-3 ~ ú) "> 0 KNOWN AS THE CENTRAL BUSINESS AREA OF SAID ru » ~ ~ (~ >J CITY BEYOND BEING ACCEP, TED FOR FILING AND ëi::o ,~ ~ ~= ~~ ESTABLISHING AN EMERGENCY:. 0, J r'""4' ~" U U (J) ~ '=: WHEREAS, the City Council of the City of San Marcos, Texas, is considering the prohibition or limitation of the location of establishments which intend to dispense alcoholic beverages within that area of San Marcos known as the Central Business Area; and, WHEREAS, on July 18, 1983, said City Council adopted an ordinance establishing a temporary 30-day moratoriUm on the processing of applications for specific use permits and conditional use permits for establishments desiring to dispense alcoholic beverages within said area so that: t:h.e City would have an adequate period of time within which to determine and adopt desirable regulations for property in said area; and, WHEREAS, though diligent effort has been expended, the City needs an additional period of time to examine and investigate the matter before making a decision on the issue of prohibiting or limiting the location of establishments which intend to dis~ pense alcoholic beverages within said area; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That no specific use permit or conditional use permit application for an establishment which desires to dispense alcoholic beverages within that area of the City of San Marcos, Texas, known as the Central Business Area shall be processed beyond being accepted for filing for a period of 30- days subsequent to the effective date of this Ordinance. SECTION 2. That for the purposes of this Ordinance the portion of the City of San Marcos, Texas, which is within the Central Business Area shall be as designated in that Ordinance of July 18,1983, which established a. temporary 30-day moratorium on said processing and which is shown on Exhibit "A" attached hereto and made a part hereof. SECTION 3. That the importance of this Ordinance creates an emergency and an imperative purpose necessary that the provisions of the charter requiring that ordinances shall be read at three separate meetings and that no ordinance shall become effective until the expiration of ten (10) days following the date of its final passage be suspended, and these provisions are hereby sus- pended, and this Ordinance shall take effect and be in full force and effect from and after its adoption and publication in a newspaper of general circulation within the City.
