155 STATE OF TEXAS X CONTRACT FOR FENCING SOFTBALL COMPLEX COUNTY OF HAYS X KNOW ALL MEN BY THESE PRESENTS: That the City of San Marcos, Texas, a municipal corporation by and under the laws of the State of Texas, hereinafter referred to as "City", acting by and through authority of its Mayor, Emmie Craddock, by resolution duly enacted on September 26, 1983, and Allied Fence Company of San Antonio,Texas, hereinafter referred to as "Contractor", do hereby enter into this agreement for the purpose of providing fencing at the San Marcos Softball Complex located adjacent to Gary Job Corp on Highway 21 within the corporate limits of the City of San Marcos, pursuant to their terms and conditions expressed herein: I. This agreement shall be in effect for a term of sixty one (61) days beginning on September 26', 1983, and ending November 26, 1983. II. The consideration to be paid by City to Contractor for the performance by Contractor of this agreement is the sum of Thirty- Five Thousand Nine Hundred Forty-Nine and 20/100 Dollars ($35,949.20). Said consideration is to be paid to Contractor in an installment of $21,569.52 upon the delivery of materials and an installment of $l4,379.68 upon the completion of installation of said fencing by Contractor and the final written acceptance of such installed fencing by the City. III. Pursuant to this agreement, Contractor agrees to furnish labor, materials, and necessary equipment to install fencing at the sites of the softball fields, as identified to the Contractor by City at the time of said installation, located adjacent to Gary Job Corp on Highway 21 within the Corporate limits of the City of San Marcos, Texas, in compliance with the Softball Complex Fencing Project Specifications attached and hereby made a part of this contract as Attachment #1 and any and all other bid specifications under which Contractor was awarded this contract.
