29 RESOLUTION 1983-57R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AND CONFIRMING THE STATEMENTS AND AFE'IRMATIONS CONTAINED IN AN AFFIDl-WIT, AUTHORIZING THE fvlAYOR Fro SIGN SUCH AFFIDAVIT AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos conveyed to Southwest Texas State University a tract in the T.J. Chambers Survey containing 0.23 acres of land by General Warranty Deed dated May 12, 1983 and recorded in Volume 394, Pages 24-26, Hays County Deed Records; and, WHEREAS, the Board of Regents, Texas State University System, on behalf of the State of Texas and Southwest Texas State University conveyed to said City certain tracts of land in the J.M. Veramendi League No. 2 by General Warranty Deed dated May 12, 1983 and recorded in Volume 394, Page 309, Hays County Deed Records; and, WHEREAS, both deeds conditioned the conveyances upon said city's construction of a certain drainage ditch upon a portion of the property conveyed by the Board of Regents to said city on or before a certain date or the properties described in both deeds would revert to the respective grantors, and, WHEREAS, Southwest Texas State University has, by and through its Vice President for Finance and Management, T.J. Marek, made affidavit, a copy of which is attached hereto as Exhibit "A" and incorporated herein for all intents and purposes, that the drainage ditch mentioned hereinabove was substantially completed on or before September 1, 1983, that the condition in both deeds that said drainage ditch be constructed has been met and that such deeds are now complete and absolute and that neither of the tracts described therein will revert to the respective grantors; and, I1HEREAS, it is in the public interest that the statements and affirmations set forth in the affidavit attached hereto as Exhibit "A" and incorporated herein for all intents and purposes be In all things approved and confirmed; and, WHEREAS, it is in the public interest -that the Mayor of the City of San Marcos make the same affidavit as thêlt made by Southwest Texas State University, a copy of which is attached hereto as Exhibit "A" and incorporated herein for all intents and purposes; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the statements and affirmations contained in the affidavit attached hereto as Exhibit "A" and incorporated herein for all intents and purposes be in all things approved and confirmed and they are hereby approved and confirmed. PART 2. That the Mayor of the City of San Marcos, Texas, be, and she is hereby, authorized to sign the affidavit attached hereto as Exhibit "A" and incorporated herein for all intents and purposes on behalf of the City of San Marcos, Texas.
