<br /> Affidavit -2- <br /> League No. 2 in San Marcos, Hays County, Texas, and being <br /> portions of that certain tract of land described in Deed from <br /> Shadrach Dixon, et ux, to the International Railroad Company <br /> (predecessor to the Missouri-Pacific Railroad Company), dated <br /> September 20, 1871, and recorded in Volume H, Pages 19-20, <br /> Hays County Deed Records. The said deed from the Board of <br /> Regents to the City of San Marcos is recorded in Volume 394, <br /> Page 309 , Hays County Deed Records. <br /> 4. Both deeds referred to in paragraphs 2 and 3 <br /> contain clauses that conditioned the conveyances upon the <br /> City's construction of a drainage ditch upon a portion of the <br /> property conveyed from the Board of Regents to the City. Both <br /> deeds provide that if the City does not construct the drainage <br /> ditch on or before September 1, 1983, the property in each <br /> deed would revert to the respective grantors. <br /> 5. Both affiants, acting as official representatives <br /> of their respective agencies, affirm and confirm: <br /> a. That the drainage ditch referred to in the <br /> two deeds described above was substantially completed on or <br /> before September 1, 1983, and <br /> b. That the condition in both deeds that the <br /> drainage ditch be constructed has been met and that such deeds <br /> are now complete and absolute, and <br /> c. That neither of the tracts described in the <br /> two deeds described herein will revert to the respective <br /> grantors. <br />
