<br /> 39 <br /> RESOLUTION 1983-59R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS; TEXAS; AUTHORIZING THE MAYOR <br /> OF SAID CITY TO BORROW FUNDS ON BEHALF OF <br /> SAID CITY F.oR THE FINANCING OF TWENTY (20) <br /> POLICE AUTOMDB1#ES AND EQUIPMENT; REQUES'rING <br /> THE STATE PURC'RASING AND GENERAL SERVICES <br /> COMMISSION TO INCLUDE SAID CITY'S STATED NEED <br /> FOR SAID AUTOMOBILES AND EQUIPMENT ON THE <br /> COMMISSION'S ANNUAL CONTRACTS FOR SUCH ITEMS <br /> WHEREBY SAID CITY MAY PURCHASE SUCH ITEMS <br /> FROM THE ANNUAL CONTRACT IN QUESTION; <br /> AUTHORIZING THE CITY MANAGER TO ACT FOR SAID <br /> CITY IN ALL MATTERS RELATING TO THE <br /> PURCHASING PROGRAM OF SAID COMMISSION AND TO <br /> SIGN AND DELIVER ALL NECESSARY REQUESTS AND <br /> OTHER DOCUMENTS IN CONNECTION THEREWITH ON <br /> BEHALF OF SAID CITY; DIRECTING ALL DECISIONS <br /> MADE BY SAID CITY MANAGER IN ALL SUCH <br /> MATTERS; AGREEING TO PURCHASE SAID <br /> AUTOMOBILES AND EQUIPMENT IN ACCORDANCE WITH <br /> THE CONTRACT MADE HEREUNDER EXCEPT IN AN <br /> EMERGENCY, TO BE RESPONSIBLE FOR PAYMENT <br /> DIRECTLY TO THE VENDOR UNDER SUCH CONTRACT, <br /> TO BE RESPONSIBLE FOR THE VENDOR'S COMPLIANCE <br /> WITH ALL CONDITIONS OF DELIVERY AND QUALITY <br /> OF SAID AUTOMOBILES AND EQUIPMENT; AND <br /> DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, by Ordinance dated September l2, 1983, the City <br /> Council of the City of San Marcos, Texas, adopted the budget <br /> for said City for the fiscal year beginning October 1, 1983 <br /> and ending on September 30, 1984 and said budget included an <br /> amount of $73,437.00 for the first of four annual repayments <br /> of a four-year loan for the financing of twenty (20) police <br /> automobiles and equipment; and <br /> WHEREAS, Hays County National Bank of San Marcos, Texas, <br /> lS the official depository of said City by virtue of <br /> Resolution No. 83-37 approving the terms and conditions of <br /> the Depository Contract To Secure Funds Of City Of San <br /> Marcos, Texas, dated September 29, 1983; and, <br /> WHEREAS, the estimated total cost of twenty (20) police <br /> automobiles and equipment is approximately $250,000.00; and, <br /> WiHEREAS, the City of San Marcos, Texas, pursuant to the <br /> authority granted by Article 664-7, Vernon's Texas Civil <br /> Statutes, as amended, desires to participate in a certain <br /> purchasing program of the State Purchasing and General <br /> Services Commission for the purchase of said automobiles and <br /> equipment; and, <br /> WHEREAS, the said City of San Marcos, Texas, is of the <br /> opinion that participation in this program will be highly <br /> beneficial to the taxpayers of this City, through the <br /> anticipated savings to be realized; now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> PART 1. That the Mayor of the City of San Marcos, <br /> Texas, be, and she is hereby, authorized to borrow funds on <br /> behalf of said city in an amount not exceeding $250,000.00 <br /> from Hays County National Bank for the financing of twenty <br /> (20) police automobiles and equipment at a rate of interest <br /> not to exceed the prime rate of interest, said funds to be <br /> repaid by tax revenues generated by the levy of ad valorem <br /> taxes by said City. <br />
