<br /> THENCE with the common line as fenced and used
<br /> upon the ground of Barnes 33.91 acre tract and
<br /> the Thermon Industrial Development Corporation
<br /> tract S44 degs. 20'16"E 1447.79 feet to the
<br /> PLACE OF BEGINNING.
<br /> WHEREAS, an on-site public hearing has not been
<br /> requested in writing by more than 20 adults residing in said
<br /> area; and,
<br /> WHEREAS, notice of said public hearing was published in
<br /> the San Marcos Daily Record, a newspaper having general
<br /> circulation in said city and in the territory proposed for
<br /> annexation, on Septerrber 25,1983, said date being not more than
<br /> twenty (20) days nor less than ten (10) days prior to the
<br /> hearing for which notice was given; and,
<br /> WHEREAS, prior to the publication of notice of said
<br /> hearing, the City Council of the City of San Marcos, Texas,
<br /> directed preparation of a service plan that provides for the
<br /> extention of municipal services to said area proposed for
<br /> annexation; and,
<br /> WHEREAS, said proposed service plan was made available
<br /> for inspection and explained to the inhabitants of the area
<br /> to be annexed at said public hearing; and,
<br /> WHEREAS, said l21.43 acres, more or less are located
<br /> within the extraterritorial jurisdiction of the City of San
<br /> Marcos, Texas, and not within the extraterritorial
<br /> jurisdiction of any other city; and,
<br /> WHEREAS, said 121.43 acres, more or less are continguous
<br /> and adjacent to the current boundaries of the City of San
<br /> Marcos, Texas; now, therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN
<br /> MARCOS, TEXAS:
<br /> SECTION 1. That the following described property, being
<br /> 121.43 acres, more or less, adjoining the existing city
<br /> limits of the City of San Marcos, Texas, out of the J.M.
<br /> Veramendi Survey No. 1, A-17, in Hays County, Texas, same
<br /> being all of the following tracts: l) a 52.49 acre tract
<br /> described in a deed from George Norman Jackson, et al, to
<br /> Jack R. Barnes, Trustee, dated August 19, 1971 and recorded
<br /> in Volume 245, Page 533 of the Hays County Deed Records, 2) a
<br /> 35.10 acre tract described in a deed from James Marcus
<br /> Jackson, et ux, to Jack R. Barnes, Trustee, dated August 19,
<br /> 1971 and recorded in Volume 245, page 283 of the Hays County
<br /> Deed Records, and 3) a 33.91 acre tract described in a deed
<br /> from George Norman Jackson Sr. to Jack R. Barnes, Trustee,
