64 ORDINANCE 1983-63 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER 29, 1980 (VOL. 54) BY CHANGING THE ZONING OF 0.16 OF AN ACRE OF .' LAND AREA IN THE J.M. VERAMENDI LEAGUE NO.2, BEING A PORTION OF LOTS 4 AND 5, BLOCK 16, RIO VISTA TERRACE ADDITION NO.4, A SUBDIVISION RECORDED IN VOLUME 163, PAGE 134 OF THE HAYS COUNTY DEED RECORDS, A/K/A 1005 IH 35 NORTH (SHAFER MOTEL), FROM "R-l" (SINGLE-FAMILY DWELLING DISTRICT) to "c" (COMMERCIAL DISTRICT). BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the following described piece of real property located in San Marcos, Hays County, Texas, which is presently zoned "R-l" (Single Family Dwelling District) henceforth shall be rezoned, as follows: 0.16 OF AN ACRE OF LAND AREA, MORE OR LESS, IN THE J.M. VERAMENDI LEAGUE NO.2, BEING A PORTION OF LOTS 4 AND 5, BLOCK 16, RIO VISTA TERRACE ADDITION NO. FOUR (4) A SUBDIVISION RECORDED IN VOLUME 163, PAGE 134, OF THE HAYS COUNTY DEED RECORDS AND BEING A PART OF THAT 62,991 SQUARE FEET OF LAND DESCRIBED IN A DEED FROM LEE HORACEFIELD, ET UX, TO ARUNKUMAR AMIN, ET UX, BY DEED DATED MAY 1, 1978 AND RECORDED IN VOLUME 310, PAGE 4 OF THE HAYS COUNTY DEED RECORDS AND BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS: COMMENCING at an iron rod found at the intersection of the northwest line of Interstate Highway No. 35 (I.H. No. 35) and the northeast line of Hutchison Street for the south corner of the Amin tract; THENCE with the common northeast line of Hutchison Street and the southwest line of the Amin tract N 50° 24'37~W 176.86 feet to an iron rod found at the south corner of Lot 1, Block 16 in the aforementioned Rio Vista Terrace, Addition No.4 and the west corner of the Amin tract; THENCE with the southeast line of Lot 1, Lot 2~ and Lot 3, being the northwest line of the Amin tract N39° 08'09"E 199.22 feet to an iron rod found at the east corner of Lot 3 and in the southwest line of Lot 4 for an angle point in the northwest line of the Amin tract, and being the west corner and PLACE OF BEGINNING of this tract; THENCE leaving the PLACE OF BEGINNING and crossing Lot 4 with the northwest line of the Amin tract N39°58'15" E 59.94 feet to an iron rod in the common line of Lot 4 and Lot 5, being a westerly north corner of the Amin tract; THENCE leaving the Amin tract and crossing Lot 5 N39° 58'15"E 94.98 feet to an iron rod set in the common line of Lot 5 and Lot 6 for the north corner of this tract; THENCE with the common line of Lot 5 and Lot 6 S45°55'03"E 44.42 feet to an iron rod set at the south corner of lot 6 and the east corner of Lot 5 and lying in the northwest line of a 40,040 square feet of land described in a deed from G & T Trading Company to United States Steel and Carnegie Pension Fundr by deed dated May 14, 1981 and recorded in Volume 35$,page 250 of the Hays County Deed Records;
