<br />64 <br />ORDINANCE 1983-63 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF <br />THAT ORDINANCE WHICH REGULATES AND RESTRICTS <br />THE LOCATION AND USE OF BUILDINGS, STRUCTURES <br />AND LAND, DATED SEPTEMBER 29, 1980 (VOL. 54) <br />BY CHANGING THE ZONING OF 0.16 OF AN ACRE OF <br />.' LAND AREA IN THE J.M. VERAMENDI LEAGUE NO.2, <br />BEING A PORTION OF LOTS 4 AND 5, BLOCK 16, <br />RIO VISTA TERRACE ADDITION NO.4, A SUBDIVISION <br />RECORDED IN VOLUME 163, PAGE 134 OF THE HAYS <br />COUNTY DEED RECORDS, A/K/A 1005 IH 35 NORTH <br />(SHAFER MOTEL), FROM "R-l" (SINGLE-FAMILY DWELLING <br />DISTRICT) to "c" (COMMERCIAL DISTRICT). <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the following described piece of real property <br />located in San Marcos, Hays County, Texas, which is presently zoned <br />"R-l" (Single Family Dwelling District) henceforth shall be rezoned, <br />as follows: <br /> <br />0.16 OF AN ACRE OF LAND AREA, MORE OR LESS, IN THE <br />J.M. VERAMENDI LEAGUE NO.2, BEING A PORTION OF LOTS <br />4 AND 5, BLOCK 16, RIO VISTA TERRACE ADDITION NO. <br />FOUR (4) A SUBDIVISION RECORDED IN VOLUME 163, PAGE <br />134, OF THE HAYS COUNTY DEED RECORDS AND BEING A PART <br />OF THAT 62,991 SQUARE FEET OF LAND DESCRIBED IN A <br />DEED FROM LEE HORACEFIELD, ET UX, TO ARUNKUMAR AMIN, <br />ET UX, BY DEED DATED MAY 1, 1978 AND RECORDED IN <br />VOLUME 310, PAGE 4 OF THE HAYS COUNTY DEED RECORDS AND <br />BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS <br />AS FOLLOWS: <br /> <br />COMMENCING at an iron rod found at the intersection of <br />the northwest line of Interstate Highway No. 35 (I.H. <br />No. 35) and the northeast line of Hutchison Street for <br />the south corner of the Amin tract; <br /> <br />THENCE with the common northeast line of Hutchison <br />Street and the southwest line of the Amin tract N 50° <br />24'37~W 176.86 feet to an iron rod found at the south <br />corner of Lot 1, Block 16 in the aforementioned Rio <br />Vista Terrace, Addition No.4 and the west corner of the <br />Amin tract; <br /> <br />THENCE with the southeast line of Lot 1, Lot 2~ and <br />Lot 3, being the northwest line of the Amin tract N39° <br />08'09"E 199.22 feet to an iron rod found at the east <br />corner of Lot 3 and in the southwest line of Lot 4 for <br />an angle point in the northwest line of the Amin tract, <br />and being the west corner and PLACE OF BEGINNING of <br />this tract; <br /> <br />THENCE leaving the PLACE OF BEGINNING and crossing Lot <br />4 with the northwest line of the Amin tract N39°58'15" <br />E 59.94 feet to an iron rod in the common line of Lot <br />4 and Lot 5, being a westerly north corner of the Amin <br />tract; <br /> <br />THENCE leaving the Amin tract and crossing Lot 5 N39° <br />58'15"E 94.98 feet to an iron rod set in the common line <br />of Lot 5 and Lot 6 for the north corner of this tract; <br /> <br />THENCE with the common line of Lot 5 and Lot 6 S45°55'03"E <br />44.42 feet to an iron rod set at the south corner of lot 6 <br />and the east corner of Lot 5 and lying in the northwest <br />line of a 40,040 square feet of land described in a deed <br />from G & T Trading Company to United States Steel and <br />Carnegie Pension Fundr by deed dated May 14, 1981 and <br />recorded in Volume 35$,page 250 of the Hays County Deed <br />Records; <br />
