<br /> RESOLUTION NO. 1983-64R
<br /> A RESOLUTION OF THE CITY COUNCIL OF THE
<br /> CITY OF SAN MARCOS, TEXAS, APPROVING FINAL
<br /> PAYMENT TO DU-MOR ENTERPRISES, A JOINT VEN-
<br /> TURE CONSISTING OF DU-MOR DRILLING AND BLAST-
<br /> ING, INC. AND ACTION UTILITY CO., INC., FOR
<br /> CONSTRUCTION OF IMPROVEMENTS CONSISTING OF
<br /> PAVING, DRAINAGE, WATER DISTRIBUTION AND
<br /> SANITARY SEWER IMPROVEMENTS ON GRAVEL STREET,
<br /> A PART OF THE PATTON STREET EXTENSION PRO-
<br /> JECT; ACCEPTING SAID PROJECT FOR USE BY SAID
<br /> CITY; AUTHORIZING FINAL PAYMENT IN THE AMOUNT
<br /> OF $6,206.65 AND DECLARING AN EFFECTIVE DATE.
<br /> WHEREAS, the City of San Marcos, Texas, has engaged the
<br /> services of Du-Mor Enterprises, a joint venture consisting of
<br /> Du-Mor Drilling and Blasting, Inc. and Action Utility Co.,
<br /> Inc., for construction of improvements consisting of paving,
<br /> drainage, water distribution and sanitary sewer improvements
<br /> on Gravel Street, a part of the Patton Street Extension
<br /> Project; and,
<br /> WHEREAS, said services were provided pursuant to a con-
<br /> tract between the City of San Marcos, Texas, and Du-Mor En-
<br /> terprises entered into on June 7, 1983; and,
<br /> WHEREAS, on September 1, 1983, September 13, 1983 and
<br /> September 28, 1983 Trinity Engineering Testing Corporation
<br /> (TETCO) tested the subgrades and base material on said pro-
<br /> ject and found the density of same to be acceptable; and,
<br /> WHEREAS, on September 9, 1983, Tony Cortez, Public Works
<br /> Inspector for said City, pressure-tested the water line on
<br /> said project and found the same to be acceptable; and,
<br /> WHEREAS, on September 12, 1983, the Texas Department of
<br /> Health tested the water system on said project and found the
<br /> same to be acceptable; and,
<br /> WHEREAS, on October 11, 1983, Bill McCauley, Superin-
<br /> tendent for Streets, Engineering and Parks for the City of
<br /> San Marcos, Texas, Tony Cortez, Public Works Inspector for
<br /> said City, and Kelly Kilber, Pro-Tech Engineering, inspected
<br /> said improvements on said project and found the same to be
<br /> acceptable; and,
<br /> WHEREAS, Tony Cortez has recommended that final payment
<br /> be made on said project; now, therefore,
<br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN
<br /> MARCOS, TEXAS:
<br /> PART 1. That the construction of improvements consisting
<br /> of paving, drainage, water distribution and sanitary sewer
<br /> improvements on Gravel Street, a part of the Patton Street
<br /> Extension Project, has been completed in substantial compli-
<br /> ance with that contract of June 7, 1983 between the City of
<br /> San Marcos, Texas and Du-Mor Enterprises, a joint venture
<br /> consisting of Du-Mor Drilling and Blasting, Inc. and Action
<br /> Utili ty Co., Inc., and said improvements are hereby accepted
<br /> for use by the City of San Marcos, Texas.
<br /> PART 2. That final payment in the amount of $6,206.65
<br /> to Du-Mor Enterprises in full and final payment for said ser-
<br /> vices is hereby authorized.
