<br /> 79 <br /> <C ORDINANCE 1983-66 <br /> * <br /> ~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> ("4,,,,/ SAN MARCOS; TEXAS; AMENDING SECTION 2':'43 OF <br /> (:1) <br /> 4"""" DIVISION 2; ENTITLED "TEXAS MUNICIPAL <br /> RETIREMENT SYSTEM" OF ARTICLE III, ENTITLED <br /> í' "CIVIL SERVICE AND EMPLOYEE BENEFITS" OF <br /> ~~ CHAPTER 2 OF THE CODE OF ORDINANCES OF SAID <br /> CITY BY AUTHORIZING ~~D ALLOWING; UNDER THE ACT <br /> I GOVERNING THE 'rEXAS MUNICIPAL RETIREMENT <br /> ~ SYSTEM, 'UPDATED SERVICE CREDIT' IN SAID SYSTEM <br /> ( FOR SERVICE PERFORMED BY QUALIFYING MEMBERS OF <br /> SUCH SYSTEM IN THE EMPLOYMENT OF SAID CITY; AND <br /> ADDING A PARAGRAPH (b) TO SAID SECTION <br /> AUTHORIZING AND ALLOWING UNDER SAID ACT <br /> 'UPDATED SERVICE CREDIT' FOR SERVICE PERFORMED <br /> BY QUALIFYING MEMBERS OF SUCH SYSTEM WHO HAVE <br /> UNFORFEITED CREDIT FOR PRIOR SERVICE AND/OR <br /> CURRENT SERVICE WITH OTHER PARTICIPATING <br /> MUNICIPALITIES BY REASON OF PREVIOUS SERVICE <br /> AND WHO WERE CONTRIBUTING MEMBERS ON JANUARY 1, <br /> 1983; AMENDING SECTION 2-44 OF SAID DIVISION <br /> AND SAID ARTICLE OF CHAPTER 2 OF SAID CODE; AL'iTD <br /> DECLARING AN EMERGENCY. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, 'rEXAS: <br /> SEC'rION 1. That Section 2-43 of the Code of Ordinances, <br /> City of San Marcos, Texas, is hereby amended to read as <br /> follows: <br /> Section 2-43. Authorization of Updated Service <br /> Credit. <br /> (a) On the terms and conditions set out in <br /> Sections 63.401 through 63.403 of Title <br /> 110B, Revised civil Statutes of Texas, 1925, <br /> as amended, each member of the Texas <br /> Municipal Retirement System who has current <br /> service credit or prior service credit in <br /> said System in force and effect on the 1st <br /> day of January, 1984, by reason of service <br /> in the employment of the City of San Marcos, <br /> and on such date has at least 36 months of <br /> credited service with said System, shall be <br /> and lS hereby allowed "Updated Service <br /> Credit" (as that term is defined in <br /> subsection (d) of Section 63.402 of said <br /> 'I'itle) in an amount that is 100% of the <br /> "base Updated Service Credit" of the member <br /> (calculated as provided in subsection (c) of <br /> Section 63.402 of said Title). The Updated <br /> Service Credit hereby allowed shall replace <br /> any Updated Service Credit, prior service <br /> credit, special prior service credit, or <br /> antecedent serVlce credit previously <br /> authorized for part of the same serVlce. <br /> (b) On the terms and conditions set out in <br /> Section 63.601 of said Title, any member of <br /> the Texas Municipal Retirement System who is <br /> eligible for Updated Service Credit on the <br /> basis of service with this City, and who has <br /> unforfeited credit for prior service and/or <br /> current service with another participating <br /> municipality or municipalities by reason of <br />
