<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br /> OF SAN MARCOS, TEXAS, VACATING AND ABANDONING
<br /> A PORTION OF EDEN STREET IN THE CITY OF SAN ~
<br /> MARCOS, TEXAS; PROVIDING FOR THE REVERSION OF (;)/

<br /> EFFECTIVE DATE. uJ
<br /> WHEREAS, Eden street in the City of San Marcos, Texas,
<br /> was and is dedicated to public use as shown by the plat of
<br /> the Victory Gardens Second Section of the City of San Marcos,
<br /> Texas, a subdivision of record in Volume 130, Page 48, Hays
<br /> County Deed Records; and,
<br /> WHEREAS, the City Council of the City of San Marcos,
<br /> Texas, hereby finds and determines that it is in the public
<br /> interest to vacate and abandon a portion of said Eden street,
<br /> said portion abutting the southwest boundary of a 0.19 acre
<br /> tract of land conveyed to Alex G. Tijerina and wife, Alvina
<br /> Lopez Tijerina, by Mateo Reyna by deed dated June 7, 1961 and
<br /> recorded in Volume 186, Page 486, Hays County Deed Record s,
<br /> said tract being out of Lots 1, 2 and 3, Block 41 of the
<br /> Second Section of victory Gardens, a subdivision of record in
<br /> Volume 130, Page 48, Hays County Deed Records; said portion
<br /> being more particularly described as follows:
<br /> BEGINNING AT A POINT, being an iron stake set at
<br /> the West corner of said 0.19 acre tract, being
<br /> also a point on the Northeast line of Eden
<br /> Street;
<br /> THENCE, on a course bearing S 200 34' W for a
<br /> distance of 3.96 feet to a point;
<br /> THENCE, on a course bearing S 680 04' E for a
<br /> distance of 83.46 feet to a point;
<br /> THENCE, on a course bearing N 200 34' E for a
<br /> distance of 3.96 feet to a point, said point
<br /> being in the Northeast line of Eden Street, said
<br /> point being also in the Southwest line of said
<br /> 0.19 acre tract;
<br /> THENCE, on a course with said Northeast line of
<br /> Eden Street bearing N 680 04' W for a distance of
<br /> 83.46 feet to the POINT OF BEGINNING;
<br /> and,
<br /> WHEREAS, the owner of all land abutting said portion of
<br /> Eden Street has executed a release, discharging the City of
<br /> San Marcos from any damages occasioned by said abandonment;
<br /> now, therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN
<br /> HARCOS, TEXAS:
<br /> SECTION 1. rrha t a portion of Eden Street, a public
<br /> street located in the victory Gardens Second section of the
<br /> City of San Marcos, Texas, said portion abutting the
<br /> southwest boundary of a 0.19 acre tract of land conveyed to
<br /> Alex G. Tijerina and wife, Alvina Lopez Tijerina, by Mateo
<br /> Reyna by deed dated June 7, 1961, and recorded in volume 186,
