<br /> 86 <br /> RESOLUTION 1983-65R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN HARCOS, TEXAS, APPROVING THE TERMS AND <br /> CONDITIONS OF AN AGREEMENT FOR MUTUAL AID IN <br /> FIRE PROTECTION BETWEEN SAID CITY AND THE <br /> SOUTH HAYS COUNTY RURAL FIRE PREVENTION <br /> DISTRICT, HAYS COUWfY, TEXAS, AUTHORIZING THE <br /> MAYOR OF SAN MARCOS TO EXECUTE SAID AGREEMENT <br /> AND DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, The state of Texas pursuant to Article 6228f, <br /> Texas Revised civil Statutes has declared it to be the public <br /> policy of the State to provide financial assistance to the <br /> surviving spouse and minor children of paid firemen when such <br /> paid firemen suffer violent death in the course of the <br /> performance of their duties; and, <br /> WHEREAS, the federal government, pursuant to 42 U.S.C.S. <br /> §3793, provides for the payment of certain benefits to the <br /> surviving spouse and/or children of public safety officers <br /> who have died as a "proximate result of a personal injury <br /> sustained in the line of duty"; and, <br /> WHEREAS, insurance contracts entered into by some <br /> firemen and various pension systems provide for the payment <br /> of death, disability and/or injury benefits when death or <br /> injury occur "in the line of duty"; and, <br /> WHEREAS, it is to the benefit of the firemen of the City <br /> of San Marcos to have clearly established that responding to <br /> or working at a fire or other emergency outside said City's <br /> jurisdictional area but within an area with which the City of <br /> San Marcos has entered into an Agreement For Mutual Aid In <br /> Fire Protection is work "in the line of duty" for City of San <br /> Marcos firemen; and, <br /> WHEREAS, the City of San Marcos has the authority, <br /> pursuant to the Texas Interlocal Cooperation Act, Article <br /> 44l3 (32c), Texas Revised Civil Statutes, to enter into <br /> agreements with a special district for the provision of fire <br /> protection services; now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> P ARrr 1. That the Agreement For Mutual Aid In Fire <br /> Protection between the City of San Marcos, Texas, and the <br /> South Hays County Rural Fire Prevention District, Hays <br /> County, Texas, a copy of which is attached hereto as Exhibit <br /> "A" and incorporated herein for all intents and purposes, be, <br /> and the same is hereby, approved in all respects. <br /> PART 2. That the Mayor of the City of San Marcos, <br /> Texas, Emmie Craddock, be, and she is hereby, authorized to <br /> execute said Agreement on behalf of the City of San Marcos, <br /> Texas. <br /> PART 3.
