86 RESOLUTION 1983-65R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN HARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT FOR MUTUAL AID IN FIRE PROTECTION BETWEEN SAID CITY AND THE SOUTH HAYS COUNTY RURAL FIRE PREVENTION DISTRICT, HAYS COUWfY, TEXAS, AUTHORIZING THE MAYOR OF SAN MARCOS TO EXECUTE SAID AGREEMENT AND DECLARING AN EFFECTIVE DATE. WHEREAS, The state of Texas pursuant to Article 6228f, Texas Revised civil Statutes has declared it to be the public policy of the State to provide financial assistance to the surviving spouse and minor children of paid firemen when such paid firemen suffer violent death in the course of the performance of their duties; and, WHEREAS, the federal government, pursuant to 42 U.S.C.S. §3793, provides for the payment of certain benefits to the surviving spouse and/or children of public safety officers who have died as a "proximate result of a personal injury sustained in the line of duty"; and, WHEREAS, insurance contracts entered into by some firemen and various pension systems provide for the payment of death, disability and/or injury benefits when death or injury occur "in the line of duty"; and, WHEREAS, it is to the benefit of the firemen of the City of San Marcos to have clearly established that responding to or working at a fire or other emergency outside said City's jurisdictional area but within an area with which the City of San Marcos has entered into an Agreement For Mutual Aid In Fire Protection is work "in the line of duty" for City of San Marcos firemen; and, WHEREAS, the City of San Marcos has the authority, pursuant to the Texas Interlocal Cooperation Act, Article 44l3 (32c), Texas Revised Civil Statutes, to enter into agreements with a special district for the provision of fire protection services; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: P ARrr 1. That the Agreement For Mutual Aid In Fire Protection between the City of San Marcos, Texas, and the South Hays County Rural Fire Prevention District, Hays County, Texas, a copy of which is attached hereto as Exhibit "A" and incorporated herein for all intents and purposes, be, and the same is hereby, approved in all respects. PART 2. That the Mayor of the City of San Marcos, Texas, Emmie Craddock, be, and she is hereby, authorized to execute said Agreement on behalf of the City of San Marcos, Texas. PART 3.
