<br /> -4- <br /> B. Each party hereto agrees to maintain its equipment <br /> to be used in such mutual aid in fire protection <br /> in good working order and to ensure that its <br /> personnel are competently trained in the use of <br /> such equipment and in firefighting in general, at <br /> a level of competency no less than the standard <br /> of professional firefighting competency COR~on to <br /> firefighting departments in the State of Texas. <br /> C. South Hays County Fire Department agrees to <br /> indemnify the San Marcos Fire Department for any <br /> loss, damage, personal injury, or death occurring <br /> as a consequence of the failure or negligence of <br /> the South Hays County Fire Department to fully <br /> comply with paragraph B of this Article V and ln <br /> carrying out a performance under Article III of <br /> this Agreement. <br /> D. San Marcos Fire Department agrees to indemnify the <br /> South Hays County Fire Department for any loss, <br /> damage, personal injury, or death occurring as a <br /> consequence of the failure or negligence of the <br /> San Marcos Fire Department to fully comply with <br /> paragraph B of this Article V and in carrying out <br /> a performance under Article II of this Agreement. <br /> VI. <br /> No party shall be reimbursed by any other party for any <br /> expenses and costs incurred pursuant to this Agreement, <br /> except as specified under Article V. <br /> VII. <br /> All equipment used by the San Marcos Fire Department in <br /> carrying out this Agreement will, at the time of action <br /> hereunder, be owned by it; and all personnel acting for the <br /> San Marcos Fire Department under this Agreement will, at the <br /> time of such action, be an employee or volunteer member of <br /> the San Marcos Fire Department and acting in the scope of <br /> that employment. <br />
