<br /> 113 <br /> RESOLUTION 1983-71R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS REQUESTING THE STATE PURCHASING <br /> AND GENERAL SERVICES COMMISSION TO INCLUDE SAID <br /> CITY'S STATED NEED FOR VISUAL EDUCATION EQUIPMENT <br /> AND SUPPLIES ON THE COMMISSION'S ANNUAL CONTRACTS <br /> FOR SUCH ITEMS WHEREBY SAID CITY MAY PURCHASE SUCH <br /> ITEMS FROM THE ANNUAL CONTRACT IN QUESTION; AUTH- <br /> ORIZING THE CITY MANAGER TO ACT FOR SAID CITY IN <br /> ALL Iv1ATTERS RELATING TO THE PURCHASING PROGRAM OF <br /> SAID COMMISSION AND TO SIGN AND DELIVER ALL NECES- <br /> SARY REQUESTS AND OTHER DOCUMENTS IN CONNECTION <br /> THEREWITH ON BEHALF OF SAID CITY; DIRECTING ALL <br /> DECISIONS MADE BY SAID CITY MANAGER IN ALL SUCH <br /> MATTERS; AGREEING TO PURCHASE SAID VISUAL EDUCA- <br /> TION EQUIPMENT AND SUPPLIES IN ACCORDANCE WITH <br /> THE CONTRACT Iv1ADE HEREUNDER EXCEPT IN AN EMERGENCY, <br /> TO BE RESPONSIBLE FOR PAYMENT DIRECTLY TO THE VEN- <br /> DOR UNDER SUCH CONTRACT, TO BE RESPONSIBLE FOR THE <br /> VENDOR'S COMPLIANCE WITH ALL CONDITIONS OF DELIVERY <br /> AND QUALITY OF SAID EQUIPMENT AND SUPPLIES; AND <br /> DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, the City of San Marcos, Texas, pursuant to the <br /> authority granted by Article 664-7, Vernon's Texas Civil Statutes, <br /> as amended, desires to participate in a certain purchasing pro- <br /> gram of the State Purchasing and General Services Commission <br /> for the purchase of visual education equipment and supplies; <br /> and, <br /> WHEREAS, the said City of San Marcos, Texas, is of the <br /> opinion that participation in this program will be highly bene- <br /> ficial to the taxpayers of this City, through the anticipated <br /> savings to be realized; now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> PART 1. That the City of San Marcos, Texas does hereby <br /> request the State Purchasing and General Services Commission to <br /> include its stated need for visual education equipment and <br /> supplies on the Commission's annual contracts for those items, <br /> whereby said City may be allowed to purchase those items ln <br /> accordance with the annual contract in question. <br /> PART 2. That the City Manager, A. C. Gonzalez, be and he <br /> is hereby, authorized to act for said City in all matters re- <br /> lating to the purchasing program of the State Purchasing and <br /> General Services Commission, and is hereby authorized and di- <br /> rected to sign and deliver all necessary requests and other <br /> documents in connection therewith for and on behalf of said <br /> City. <br /> PART 3. That all decisions made by said City Manager in <br /> all matters relating to said program will be directed by the <br /> City Council of the City of San Marcos, Texas. <br /> PART 4. That the City of San Marcos, Texas, will purchase <br /> said equipment and supplies in accordance with the contract made <br /> hereunder, except in an emergency. <br /> PART 5. That said City will be responsible for payment <br /> directly to the vendor under such contract. <br /> PART 6. That said City will be responsible for the vendor's <br /> compliance with all conditions of delivery and quality of said <br /> equipment and supplies. <br />
