NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, THAT: <br />Section 1. All matters stated in the preamble of this Ordinance are found to be true and correct <br />and are incorporated into the body of this Ordinance as if copied in their entirety. <br />Section 2. One half of the tax increment generated on property within the Zone shall be remitted <br />to Hays County to be used to reimburse TxDOT for Project costs pursuant to, and subject to the <br />terms of, an interlocal agreement between the City and the County.. <br />Section 3. The "City of San Marcos and Hays County Interlocal Agreement to Participate in the <br />Funding of the Development of FM 110" attached hereto as Exhibit "B" is approved and the City <br />Manager is authorized to take such actions as are necessary to implement such agreement. <br />Section 4. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly <br />repealed. <br />Section 5. The invalidity of any section or provision of this Ordinance shall not invalidate other <br />sections or provisions thereof. <br />Section 6. The City Council hereby finds and declares that written notice of the date, hour, place <br />and subject of the meeting at which this Ordinance was adopted was posted and that such <br />meeting was open to the public as required by law during all times during which this Ordinance <br />and the subject matter hereof were discussed, considered, and formally acted upon, all as <br />required by the Texas Open Meetings Act, Chapter 551, Texas Government Code, as amended, <br />and the Act. <br />PASSED AND APPROVED on first reading on May 6, 2014. <br />PASSED, APPROVED AND ADOPTED on second reading on May 20, 2014. <br />_D el Guerrero <br />Mayor <br />
