12 Regular Meeting October 14, 1985 Page 12 Adoption of Ordinance on third and final reading by con- sensus of all Council Members except Mr. Guerra abstaining: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING THE MAYOR TO EXECUTE A CORRECTION DEED FROM SAID CITY CONVEYING A PART OF LOTS NUMBERS SEVEN ( 7) AND EIGHT ( 8) IN BLOCK NUMBER SEVEN (7) OF THE D. S. COMBS ADDITION TO THE CITY OF SAN MARCOS, TEXAS, TO LUCY G. BADILLO, TRUSTEE FOR TERESA ANN GUERRA, TRICIA MAE GUERRA AND TINA MARIE GUERRA; AND DECLARING AN EFFECTIVE DATE. Mayor Craddock then introduced for consideration approval of an Ordin- ance on second reading, which was removed from the consensus Agenda, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CODE OF ORDINANCES OF SAID CITY TO INCLUDE AN APPENDIX H, TO BE ENTITLED "PUBLIC RIGHT-OF-WAY ACCESS AND CONSTRUCTION ORDINANCE", REGU- LATING THE SITING, DESIGN AND CONSTRUCTION OF DRIVEWAYS WHICH ACCESS PUBLIC STREETS, AND REGULATING OTHER CON- STRUCTION WITHIN THE PUBLIC RIGHT-OF-WAY BY DEFINING TERMS; REQUIRING PERMITS FOR SAID CONSTRUCTION; AUTEOR- IZING TEE CITY ENGINEER TO DETERMINE THE EFFECTS OF SAID CONSTRUCTION UPON THE RIGHT OF THE PUBLIC TO FREE AND UNHAMPERED PASSAGE OVER PUBLIC STREETS AND SIDEWALKS AND UPON TEE PUBLIC SAFETY, TO DETERMINE THE ADEQUACY OF MATERIALS USED IN SAID CONSTRUCTION, AND TO PROMULGATE DESIGN STANDARDS FOR SAID CONSTRUCTION; ESTABLISHING THAT FEES SHALL BE REQUIRED FOR SAID PERMITS; PROVIDING AN EFFECTIVE TERM FOR SAID PERMITS; EXEMPTING CERTAIN CONSTRUCTION FROM COMPLIANCE; PROVIDING PENALTIES; PROVIDING FOR APPEALS; PROVIDING FOR SEPARABILITY; AND DECLARING AN EFFECTIVE DATE. Mayor Craddock moved for approval of the Ordinance on second reading and Mr. Coddington seconded the motion. The Council was furnished copies of mapsthat need to be added to the Policy attached to the Ordinance (Ordinance needs to be amended at future meeting to add maps). The Council discussed amendment needs to be made in Sec. 4 that if the City causes a driveway to be closed (after five years), that the City shall be responsible for the cost of removing and replacing any curbs and sidewalks involved. The Council discussed in Sec. 3 .A. (3) what the time frame would be for the engineer to study and give an answer; and in Sec. 3.A. (4)c. that multiple drive- way approaches should be allowed if a circular drive is desirable. No formal amendments were made to the Ordinance at second reading. On roll call for approval of the Ordinance on second reading, the following vote was recorded: AYE: Brown, Farr, Craddock, Kissler, Nicola. NAY: Coddington, Guerra. ABSTAIN: None.
