<br />62 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Regular Meeting October 28, 1985 Page 16 <br /> <br /> <br />Mayor Craddock moved the Council adjourn into Executive Session pur- <br />suant to Article 6252-17, §§2(e), (f) and (g), V.A.C.S., to discuss <br />matters where the duties of the City Attorney to the City pursuant <br />to the Code of Professional Responsibility of the State Bar of Texas <br />clearly conflicts with Article 6252-17; exchange of real property; <br />evaluation and duties of a public officer or employee, respectively, <br />and Mr. Farr seconded the motion, which passed unanimously (12:55 p.m.). <br /> <br />Mr. Farr moved the Council reconvene at 1:23 a.m. and Mr. Brown seconded <br />the motion, which passed unanimously. <br /> <br />Mayor Craddock introduced a discussion regarding violations occurring <br />during the Moratorium on the construction of and building permits for <br />off-premise outdoor advertising signs within the jurisdiction of the <br />City. Dan Gibson advised the Council Ivar Gunnarson had two violations <br />and Sign Arts had one violation, which had begun construction after the <br />Moratorium was passed without City permits. <br /> <br />Mayor Craddock introduced for consideration authorization to file injunc- <br />tion action against Tereso Tobias and Ivar Gunnarson. Mr. Farr dis- <br />cussed with Staff if the billboards in process could be held until the <br />Sign Ordinance 1S in place. Staff advised the Council some billboards <br />were in close proximity and the Ordinance will probably prohibit bill- <br />boards from being closer than 1,500 feet apart. Mr. Coddington stated <br />he would be in favor of a compromise being worked out. Mr. Brown <br />moved to table this matter with no further construction to take place, <br />and Mayor Craddock seconded the motion, which passed unanimously. <br /> <br />Mayor Craddock introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, DECLARING A MORATORIUM UNTIL DECEMBER <br />31, 1985, ON THE CONSTRUCTION OF AND BUILDING PERMITS <br />FOR OFF-PREMISE OUTDOOR ADVERTISING SIGNS ANYWHERE <br />WITHIN THE JURISDICTION OF THE CITY OF SAN MARCOS; <br />PROVIDING FOR VARIANCES; AND DECLARING AN EMERGENCY. <br /> <br />Mayor Craddock moved for adoption of the Ordinance on emergency and <br />Mr. Guerra seconded the motion. Mayor Craddock moved to amend the <br />Ordinance in Section 3.a. to add the words "if applicable" at the <br />end of that subsection and Mr. Farr seconded the motion, which <br />passed unanimously. On roll call for the adoption of the Ordinance, <br />the Council voted unanimously for adoption. <br /> <br />Mayor Craddock introduced for consideration a request from Ivar Gunnar- <br />son to amend the above Moratorium Ordinance which establishes criteria <br />for the granting of variances. Mr. Gunnarson presented eight proposed <br />billboards for the Council to consider allowing him to continue working <br />on. Mr. Brown moved to stay with the variances now in place in the <br />Moratorium Ordinance adopted by the Council previous to this item and <br />Mayor Craddock seconded the motion. On roll call the following vote <br />was recorded: <br /> <br />AYE: Brown, Craddock, Nicola. <br /> <br />NAY: Coddington, Farr, Kissler. <br />ABSTAIN: Guerra. <br />The motion failed, and no futher action was taken. <br />
