M. VERAMENDI SURVEY <br /> NO. 1, HAYS COUNTY, TEXAS, BEING A PORTION OF THAT <br /> 765.04 ACRE TRACT OF LAND DESCRIBED IN EXHIBITS A AND <br /> B AS CONVEYED TO HANDLER SMITH, ET AL, BY PARTITION <br /> DEED DATED MARCH 21, 1972, AND RECORDED IN VOLUME 249, <br /> PAGE 177, HAYS COUNTY DEED RECORDS, AND THAT 0.74 ACRE <br /> TRACT OF LAND CONVEYED TO HANDLER SMITH AND HOWARD R. <br /> SHELTON BY CHARLES TERRY ALLEN, ET UX, BY DEED DATED <br /> MARCH 24, 1967, AND RECORDED IN VOLUME 216, PAGE 388, <br /> HAYS COUNTY DEED RECORDS, LOCATED ON THE NORTHWEST SIDE <br /> OF HUNTER ROAD IN WILLOW CREEK ESTATES, FROM "LD" (LOW <br /> DENSITY RESIDENTIAL) TO "c" ( COMMERC IAL) AND DECLARING <br /> AN EFFECTIVE DATE. <br /> Mayor Craddock opened the public hearing and asked if anyone wished to <br /> speak in favor or in opposition to the land use change. No one did, so <br /> Mayor Craddock closed the public hearing. Mr. Guerra moved for adoption <br /> of the Resolution and Ms. Kissler seconded the motion, which passed unani- <br /> mously. <br /> Mayor Craddock introduced for consideration a public hearing and adoption <br /> of a Resolution, the caption which was read as follows: <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING THE FUTURE LAND USE PLAN (MAP) <br /> OF THE MASTER PLAN OF SAID CITY FOR 0.486 ACRES OF <br /> LAND AND BEING A PORTION OF LOTS 2 AND 13, BLOCK 1 <br /> OF THE LINDSEY HARVEY ADDITION, SAID SUBDIVISION BEING <br /> RECORDED IN VOLUME E, PAGE 415 OF THE DEED RECORDS OF <br /> HAYS COUNTY, TEXAS, AND BEING THE SAME PROPERTY AS <br /> FOUND ON THE GROUND DESCRIBED IN DEED RECORDED IN <br /> VOLUME 405, PAGE 413, OF THE DEED RECORDS OF HAYS <br /> COUNTY, TEXAS; A/KIA 526 A & B WEST SAN ANTONIO STREET, <br /> FROM "LD" (LOW DENSITY RESIDENTIAL) TO "HD" (HIGH DENSITY <br /> RESIDENTIAL) AND DECLARING AN EFFECTIVE DATE. <br /> Mayor Craddock opened the public hearing and asked if anyone wished to <br /> speak in favor of the land use request. Tony McGee was present repre- <br /> senting the Winkenbachs, and the land use change is needed to place it <br /> in conformance with the zoning of "MF-4". No one else wished to speak <br /> in favor or in opposition to the land use change, so Mayor Craddock <br /> closed the public hearing. Mr. Guerra moved for adoption of the Resolu- <br /> tion and Ms. Kissler seconded the motion. On roll call the following <br /> vote was recorded: <br /> AYE: Guerra. <br /> NAY: Brown, Coddington, Craddock, Kissler, Nicola. <br /> ABSTAIN: None. <br /> The motion failed. Mayor Craddock then moved to amend the Resolution <br /> from Low Density to Medium Density and for adoption and Mr. Brown se- <br /> conded the motion, which passed unanimously (This action was in accord- <br /> ance with the Planning Commission's recommendation of Medium Density). <br /> Mayor Craddock introduced for consideration a public hearing and approval <br /> of an Ordinance on first reading, the caption which was read as follows: <br />
