83 Regular Meeting November 14, 1985 Page 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE FUTURE LAND USE PLAN (MAP) OF THE MASTER PLAN OF SAID CITY FOR 7.99 ACRES OF LAND, MORE OR LESS, OUT OF THE J. M. VERAMENDI SURVEY NO. 1, HAYS COUNTY, TEXAS, BEING A PORTION OF THAT 765.04 ACRE TRACT OF LAND DESCRIBED IN EXHIBITS A AND B AS CONVEYED TO HANDLER SMITH, ET AL, BY PARTITION DEED DATED MARCH 21, 1972, AND RECORDED IN VOLUME 249, PAGE 177, HAYS COUNTY DEED RECORDS, AND THAT 0.74 ACRE TRACT OF LAND CONVEYED TO HANDLER SMITH AND HOWARD R. SHELTON BY CHARLES TERRY ALLEN, ET UX, BY DEED DATED MARCH 24, 1967, AND RECORDED IN VOLUME 216, PAGE 388, HAYS COUNTY DEED RECORDS, LOCATED ON THE NORTHWEST SIDE OF HUNTER ROAD IN WILLOW CREEK ESTATES, FROM "LD" (LOW DENSITY RESIDENTIAL) TO "c" ( COMMERC IAL) AND DECLARING AN EFFECTIVE DATE. Mayor Craddock opened the public hearing and asked if anyone wished to speak in favor or in opposition to the land use change. No one did, so Mayor Craddock closed the public hearing. Mr. Guerra moved for adoption of the Resolution and Ms. Kissler seconded the motion, which passed unani- mously. Mayor Craddock introduced for consideration a public hearing and adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE FUTURE LAND USE PLAN (MAP) OF THE MASTER PLAN OF SAID CITY FOR 0.486 ACRES OF LAND AND BEING A PORTION OF LOTS 2 AND 13, BLOCK 1 OF THE LINDSEY HARVEY ADDITION, SAID SUBDIVISION BEING RECORDED IN VOLUME E, PAGE 415 OF THE DEED RECORDS OF HAYS COUNTY, TEXAS, AND BEING THE SAME PROPERTY AS FOUND ON THE GROUND DESCRIBED IN DEED RECORDED IN VOLUME 405, PAGE 413, OF THE DEED RECORDS OF HAYS COUNTY, TEXAS; A/KIA 526 A & B WEST SAN ANTONIO STREET, FROM "LD" (LOW DENSITY RESIDENTIAL) TO "HD" (HIGH DENSITY RESIDENTIAL) AND DECLARING AN EFFECTIVE DATE. Mayor Craddock opened the public hearing and asked if anyone wished to speak in favor of the land use request. Tony McGee was present repre- senting the Winkenbachs, and the land use change is needed to place it in conformance with the zoning of "MF-4". No one else wished to speak in favor or in opposition to the land use change, so Mayor Craddock closed the public hearing. Mr. Guerra moved for adoption of the Resolu- tion and Ms. Kissler seconded the motion. On roll call the following vote was recorded: AYE: Guerra. NAY: Brown, Coddington, Craddock, Kissler, Nicola. ABSTAIN: None. The motion failed. Mayor Craddock then moved to amend the Resolution from Low Density to Medium Density and for adoption and Mr. Brown se- conded the motion, which passed unanimously (This action was in accord- ance with the Planning Commission's recommendation of Medium Density). Mayor Craddock introduced for consideration a public hearing and approval of an Ordinance on first reading, the caption which was read as follows:
