<br /> 116 <br /> Special Meeting Special Meeting Page 3 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, GRANTING THE CONSENT OF THE CITY OF <br /> SAN MARCOS TO THE CREATION OF A MUNICIPAL UTILITY <br /> DISTRICT: HAYS COUNTY MUNICIPAL UTILITY DISTRICT NO. <br /> 2, SUBcTEC'l' TO VARIOUS TERMS AND CONDITIONS SET FORTH <br /> IN A SEPARATE AGREEMENT MADE A PART OF THIS ORDINANCE; <br /> SUSPENDING THE RULE REQUIRING THE READING OF ORDINANCES <br /> ON THREE ( 3) SEPARATE DAYS; AND DECLARING AN EMERGENCY. <br /> Mayor Craddock moved for approval of the Ordinance on first reading, <br /> and for the Ordinance to be amended to reflect approval on first read- <br /> ing rather than adoption on emergency and Ms. Kissler seconded the <br /> motion. On roll call the following vote was recorded: <br /> AYE: Brown, Craddock, Guerra, Kissler, Nicola. <br /> NAY: None. <br /> ABSTAIN: Coddington. <br /> Mayor Craddock introduced for consideration adoption of an Ordinance <br /> on emergency, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, GRANTING ThE CONSENT OF THE CITY OF <br /> SAN ~ffiRCOS TO THE CREATION OF A MUNICIPAL UTILITY <br /> DISTRICT: HAYS COUNTY MUNICIPAL UTILITY DISTRICT <br /> NO. 3, SUBJECT TO VARIOUS TERMS AND CONDI'l'IONS SET <br /> FORTH IN A SEPAP~TE AGREEMENT MADE A PART OF THIS <br /> ORDINANCE; SUSPENDING THE RULE REQUIRING THE READING <br /> OF ORDINANCES ON THREE ( 3) SEPARATE DAYS; AND DECLARING <br /> AN EMERGENCY. <br /> Mayor Craddock moved for approval of the Ordinance on first reading, <br /> and for the Ordinance to be amended to reflect approval on first read- <br /> ing rather than adoption on emergency and Mr. Brown seconded the motion. <br /> On roll call the following vote was recorded: <br /> AYE: Brown, Craddock, Guerra, Kissler, Nicola. <br /> NAY: None. <br /> ABSTAIN: Coddington. <br /> Ms. Kissler moved the Council adjourn into Executive Session pursuant <br /> to Article 6252-17, §2 (e), V.A.C.S., to discuss matters where the duties <br /> of the City Attorney to the City pursuant to the Code of Professional <br /> Responsibility of the State Bar of Texas clearly conflicts with Article <br /> 6252-17, and Mr. Guerra sesonded the motion, which passed unanimously <br /> (6~12 p.m.). <br /> Mr. Guerra moved the Council reconvene at 6:35 p.m. and Mr. Brown se- <br /> conded the motion, which passed unanimously. <br /> Mayor Craddock introduced for consideration employment of consultant <br /> to assist the City in evaluating LCRA proposal to purchase electrical <br /> system and direction for preparation of contract documents. Mr. Cod- <br /> dington moved for employment of Black and Veatch and Saffer, to assist <br /> the City by Joint Venture, and Mr. Nicola seconded the motion, which <br /> passed unanimously. <br />
