RESOLUTION 2014 -90R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE PROCUREMENT OF SERVICES <br />NECESSARY TO REMOVE AN INOPERABLE PUMP FROM <br />SPRINGLAKE WELL NUMBER ONE FROM LAYNE WATER <br />RESOURCES AS A PROCUREMENT EXEMPT FROM THE STATE <br />COMPETITIVE BIDDING REQUIREMENTS IN THE ESTIMATED <br />AMOUNT OF $130,228.00; AUTHORIZING THE CITY MANAGER OR <br />HIS DESIGNEE TO EXECUTE THE APPROPRIATE PROCUREMENT <br />DOCUMENTS ON BEHALF OF THE CITY AND DECLARING AN <br />EFFECTIVE DATE. <br />1. In February of 2014, while conducting maintenance and repair work at Springlake <br />Well Site, the #1 well was found to be immobilized within the pump casing and inoperable. <br />2. The wells at Springlake are backup wells to the City's Surface Water Treatment <br />Plant and must be operable in order to supply a sufficient volume of water to the City in the event <br />of a problem at the Surface Water Treatment Plant. <br />3. Section 252.022(a)(3) of the Texas Local Government Code permits a limited <br />exemption from the State competitive bidding requirements for a procurement necessary due to <br />unforeseen damage to public machinery, equipment or other property. <br />4. The City considers this service a procurement exempt from the requirements of <br />competitive bidding under the Texas Local Government Code due to the unforeseen nature of the <br />damage to the pump. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The exempt procurement of services necessary to remove an inoperable <br />pump from Springlake Well No. 1 from Layne Water Resources in the estimated amount of <br />$130,228.00 is approved. <br />PART 2. The City Manager or his designee is authorized to execute the appropriate <br />procurement documents on behalf of the City. <br />PART 3. This Resolution will be in full force and effect immediately from and after <br />its passage. <br />
