ORDINANCE NO. 2014 -35 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING CHAPTER 4, ARTICLE 4 OF THE <br />CITY'S LAND DEVELOPMENT CODE BY ADDING A NEW DIVISION 3 <br />THAT ESTABLISHES SUPPLEMENTAL MULTIFAMILY <br />RESIDENTIAL DESIGN STANDARDS; PROVIDING A SAVINGS <br />CLAUSE; PROVIDING FOR THE REPEAL OF ANY CONFLICTING <br />PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The City's Planning and Zoning Commission has recommended amendments to <br />Chapter 4, Article 4 of the City's Land Development Code that establish supplemental <br />multifamily residential design standards. <br />2. The adoption of this Ordinance is in the interest of the public health, safety and <br />welfare. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Chapter 4, Zoning Regulations, Article 4, Supplemental Standards, of the <br />City of San Marcos Land Development Code is hereby amended by adding a new Division 3, <br />Multifamily Residential Design Standards, as shown in Exhibit A, attached hereto and made a <br />part hereof for all purposes. <br />SECTION 2. The newly added Division 3, including captions, numbering, fonts and <br />indentations, may be formatted consistent with the usual and customary formatting of the San <br />Marcos City Code and Chapter 4 of the Land Development Code. <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this Ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this Ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this Ordinance are repealed. <br />SECTION 5. This Ordinance will take effect immediately after its passage, approval <br />and adoption on second reading. <br />PASSED AND APPROVED on first reading on June 17, 2014. <br />
