ORDINANCE NO. 2014 -35 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING CHAPTER 4, ARTICLE 4 OF THE CITY'S LAND DEVELOPMENT CODE BY ADDING A NEW DIVISION 3 THAT ESTABLISHES SUPPLEMENTAL MULTIFAMILY RESIDENTIAL DESIGN STANDARDS; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR THE REPEAL OF ANY CONFLICTING PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. RECITALS: 1. The City's Planning and Zoning Commission has recommended amendments to Chapter 4, Article 4 of the City's Land Development Code that establish supplemental multifamily residential design standards. 2. The adoption of this Ordinance is in the interest of the public health, safety and welfare. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Chapter 4, Zoning Regulations, Article 4, Supplemental Standards, of the City of San Marcos Land Development Code is hereby amended by adding a new Division 3, Multifamily Residential Design Standards, as shown in Exhibit A, attached hereto and made a part hereof for all purposes. SECTION 2. The newly added Division 3, including captions, numbering, fonts and indentations, may be formatted consistent with the usual and customary formatting of the San Marcos City Code and Chapter 4 of the Land Development Code. SECTION 3. If any word, phrase, clause, sentence, or paragraph of this Ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this Ordinance will continue in force if they can be given effect without the invalid portion. SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this Ordinance are repealed. SECTION 5. This Ordinance will take effect immediately after its passage, approval and adoption on second reading. PASSED AND APPROVED on first reading on June 17, 2014.
