ORDINANCE 2014 -37 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING CHAPTER 14, ARTICLE 3, <br />RESIDENTIAL CODE FOR ONE AND TWO- FAMILY DWELLINGS, OF <br />THE CITY OF SAN MARCOS CODE OF ORDINANCES TO APPLY <br />STRICTER FIRE SAFETY STANDARDS, INCLUDING THE <br />REQUIREMENT OF FIRE SPRINKLER SYSTEMS, TO COTTAGE <br />STYLE MULTI - FAMILY DWELLINGS; PROVIDING A SAVINGS <br />CLAUSE; PROVIDING FOR THE REPEAL OF ANY CONFLICTING <br />PROVISIONS;AND PROVIDING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The city council wishes to alleviate impacts from rent by the bedroom <br />construction problems and provide minimum safety features for high density living. Current code <br />classifications of buildings in Texas have not kept up with the sprawling high density use of one <br />and two - family dwellings for congregate living. <br />2. The desired result of the congregate living designation is to provide consistent and <br />equitable safety protection features for high density residential uses. Many safety features have <br />been removed by exemption conflicts in state mandates including fire sprinkler systems, smaller <br />evacuation stairs and safety handrails. <br />3. In an effort to support states mandates and provide the safety features congregate <br />living facilities need, changes to meet the intentions of the national construction codes are <br />encouraged. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1: Section 14.041 of the San Marcos Code of Ordinances is amended to <br />insert local amendments to the International Residential Code, as adopted and amended by the <br />City, as set forth below (added text is indicated by underlining): <br />Section R101.2 SCOPE <br />Exception: <br />1. Live /work units complying with the requirements of Section 419 of the <br />International Building Code shall be permitted to be built as one- and two - family <br />dwellings or townhouses. Fire suppression required by Section 419.5 of the <br />International Building Code when constructed under the International Residential <br />Code for One- and Two-family Dwellings shall conform to Section 903.3.1.3 of <br />the International Building Code. <br />
