ORDINANCE NO. 2014-39 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING THE ELECTRIC UTILITY LINE <br />EXTENSION POLICY TO REQUIRE CUSTOMERS TO PAY ALL <br />COSTS OF LINE EXTENSIONS ABOVE $1,500; AMENDING CHAPTER <br />86, ARTICLE 4 OF THE SAN MARCOS CITY CODE TO PROVIDE FOR <br />THE PRO RATA REIMBURSEMENT OF THE COST OF ELECTRIC <br />LINE EXTENSIONS TO QUALIFYING PARTIES; PROVIDING FOR <br />PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The City's electric utility line extension policy is hereby amended to read <br />as set forth in Exhibit A attached to this ordinance and incorporated herein by reference. As a <br />result of this change, customers will bear the responsibility for payment of all costs above $1,500 <br />for line extensions. <br />SECTION 2. Chapter 86, Utilities, Article 4, Electricity, of the San Marcos City Code, <br />is amended by creating a new Division 1 entitled: "DIVISION 1. IN GENERAL" within which <br />division shall be included sections 86.176 through 86.178. <br />SECTION 3. Chapter 86, Utilities, Article 4, Electricity, of the San Marcos City Code, <br />is amended by adding a new Division 2, to read as follows: <br />DIVISION 2. PRO RATA FEES FOR ELECTRIC UTILITY EXTENSIONS <br />Sec. 86.179. Effective date. <br />This division shall amply only to electric primary line extensions for which <br />application is made on or after October 1, 2014. <br />Sec. 86.180. Meaning of terms. <br />Within this division, the term "director" shall mean the city manager or the <br />city official designated by the city manager to be responsible for the management <br />of the city's electric utilitysystem. <br />Sec. 86.181. Pro rata fees to be established. <br />(a) Nature of fee. A charge known as a "pro rata fee" may be assessed <br />against all property abutting the easement or public right -of -way in which an <br />electric primary line is located and that is eligible to be served by the line and for <br />which a pro rata fee assessment has been requested and approved or imposed in <br />accordance with this division. The pro rata fees collected will be used to <br />reimburse all or a portion of the eligible costs to construct the line.
