<br />(A) 10 square miles (exclusive of lakes and waterways); or <br />(B) five percent of the area of the municipality, county, or <br />combination of municipalities or counties designating the area as an <br />enterprise zone, but not more than 20 square miles (exclusive of lakes <br />and waterways); <br />(3) has been naninated as an enterprise zone in a resolution <br />adopted by the legislative body of the applicable municipality, county, <br />or combination of municipalities or counties; and <br />(4) is an area with pervasive poverty, unemployment, and economic <br />distress <br />(b) An area is an area of pervasive poverty ,unemployment, and <br />economic distress if the average rate of unemployment in the area <br />during the most recent 12-month period for which data is available was <br />at least one and one-half times the local, state, or national average <br />for that period and the area meets one or more of the following <br />criteria: <br />(1) the area was a low-income poverty area according to the most <br />recent federal census; <br />(2) the area is in a jurisdiction or pocket of poverty eligible <br />for urban develo¡:xnent action grants under federal law; <br />(3) at least 70 percent of the residents of the area have an <br />income below 80 percent of the median income of the residents of the <br />locality or state, whichever is lower; <br />(4) the nominating government establishes to the satisfaction of <br />the commission that either: <br />(A) chronic abandonment or demolition of commercial or <br />residential structures exists in the area; or <br />(B) substantial tax arrearages for commercial or residential <br />structures exist in the area. <br />(c) An area may be designated as an enterprise zone for a <br />maximum period of seven years. A designation remains in effect until <br />September 1 of the final year of the designation. <br />(d) The commission may remove the designation of any area as an <br />enterprise zone if the area no longer meets the criteria for <br />designation as set out in this Act or by ruìe adopted under this Act by <br />the commission or if the commission determines that the governing body <br /> 4 '- I <br /> '~~ <br /> \ ¡ <br /> ~. <br /> 0\ u I ---~~ '" \ <br /> --J", <br />
