Agreement. Prosecutor and City agree that Prosecutor shall be paid a fee of <br />$60.00 per hour. Prosecutor will invoice the City monthly. The invoices shall <br />show the date services were provided, the nature of the work performed, and <br />time expended on each matter in tenth of an hour increments. Except as <br />otherwise specifically provided in this Agreement, any expenses or costs <br />incurred by Prosecutor shall not be reimbursed by City unless authorized in <br />advance by the San Marcos City Attorney's Office. Travel time and expenses of <br />commuting to and from court will not be compensated or reimbursed. City <br />Council approval of this Agreement shall be obtained if Prosecutor's cumulative <br />monthly invoices for services hereunder exceed $50,000. <br />7. Prosecutor and City agree that this Agreement may be terminated by either party <br />without cause and without recourse upon 30 days written notice or at any time <br />by mutual agreement in writing. In the event of termination of this Agreement, <br />Prosecutor shall be paid for hours worked through the termination date specified <br />in the written termination notice or written termination agreement. <br />8. Prosecutor and City agree that City shall provide stationery, metered postage, <br />and use of a copier for Prosecutor's official correspondence. <br />9. Prosecutor and City agree that this Agreement may be modified only by written <br />amendment executed in duplicate originals. <br />10.
