Morris and Members <br /> of the City Council <br />FROM: Gayle Mallia Grassle <br /> Assistant City Attorney <br />SUBJECT: Alternatives to Proposed Part 14 & Part 15 of General <br /> Zoning Ordinance Amendments (attached). <br />DATE: <br /> April 7, 1989 <br /> Per your request for alternatives to Part 14 and Part IS, relating <br /> to vehicle dealerships, which were deleted from the amendments of <br /> the Zoning Ordinance at your March 27, 1989 meeting, I am <br /> providing the following for your consideration. <br /> Part 14 - Providing new off-street parking requirements. Sec. <br /> 37(A). <br /> Alternative 1 - Leave "as is" <br /> If the Council adopts no language adding a "vehicle sales or <br /> rental dealership" classification to the off-street parking <br /> requirements of the zoning ordinance, that use will remain <br /> unclassified and, therefore, subject to the provisions of <br /> paragraph 24, of subsection 37(B). That is, the parking <br /> requirement for vehicle sales or rental dealerships will be based <br /> on the minimum standard which applies to one of the classified <br /> uses which is most closely related to vehicle dealerships as <br /> determined by the Director of Planning. The Director of Planning <br /> has traditionally determined that car dealerships are more closely <br /> related to the "Retail and other commercial uses" classification <br /> --1:2SØ square feet of gross floor area. <br /> Leaving the ordinance as is will not relieve vehicle dealerships <br /> from off-street parking requirements. It merely leaves the "how <br /> much" decision to the director of Planning. <br /> Alternative 2 - Add language which specifies a "vehicle <br /> dealership" classification based on their specific <br /> characteristics. <br /> The possibilities are numerous. One proposal, recommended by the <br /> Planning Department and Zoning Commission was deleted from the <br /> ordinance amendments during the last council meeting. Because <br /> this issue seems to come up with some frequency and because <br /> vehicle dealerships sometime challenge the Planning Director's <br /> determination, we would agree with the Planning Department and <br />
