<br />ORDINANCE NO. 2007 - 56 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING SECTION 2.566 OF THE CITY <br />CODE TO INCREASE THE PURCHASING AUTHORITY OF THE <br />CITY MANAGER; AND INCLUDING PROCEDURAL <br />PROVISIONS. <br /> <br />RECITALS: <br /> <br />1. Section 8.17 of the City Charter authorizes the City Council to "convey upon the city <br />manager general authority to contract for expenditures without further approval of the council for <br />all budgeted items not requiring competitive bidding or proposals under state law". <br /> <br />2. In the last legislative session, SB 1765 was passed increasing the threshold for <br />requiring competitive bidding and proposals for cities from $25,000 to $50,000. <br /> <br />3. The City Council wishes to amend City Code Section 2.566 to increase the City <br />Manager's purchasing authority to correspond to the change in State law made in 2007. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Section 2.566 of the City Code is amended as follows (underlining indicates <br />added text; ovcrstrikc indicates deleted text): <br /> <br />Sec. 2.566. Authority of city manager--Contract~ for expenditures; limitation. <br /> <br />( a) The city manager is authorized to contract on behalf of the city for the purchase of <br />goods and services without further city council approval for all budgeted items not <br />exceeding $50,000.00 $25,000.00. <br /> <br />(b) The city manager is authorized to promulgate purchasing policies and procedures for all <br />purchases made by the city. The city manager may amend these policies from time to time. <br />All these policies shall conform to applicable requirements of the Charter, city ordinances <br />and state laws and are subject to review and approval by the city attorney. <br /> <br />( c) The city manager or designee is authorized to determine the purchase method for goods <br />and services that provides the best value to the City in accordance with state law. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions of <br />this ordinance shall remain in effect as if the unconstitutional or invalid portion had not been <br />adopted. <br />
