continuation of the extraterritorial status and deferring annexation of the of the newly <br />added 634.592 acre tract of land until a subdivision plat or any related development <br />document is filed for the property. <br />7. Pursuant to Section 43.035 of the Texas Local Government Code, the City <br />is authorized to offer to enter into a development agreement under Section 212.172 of the <br />Texas Local Government Code for the purpose of guaranteeing the continuation of the <br />extraterritorial jurisdiction of land and enforcing the City's land use regulations under <br />terms of the agreement. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The City Council finds the above recitals to be true and correct. <br />PART 2. The City Council hereby expresses its support for the proposed La Cima <br />development project that would add approximately 634.59 acres to the existing development, <br />formerly referred to as "Lazy Oaks Ranch," located in the City's extraterritorial jurisdiction in <br />the area of Wonder World Drive and Old Ranch Road 12. <br />PART 3. Pursuant to Section 43.035 of the Texas Local Government Code, the City <br />of San Marcos, Texas hereby offers Lazy Oaks Ranch L.P. the attached development agreement <br />under Section 212.172 of the Texas Local Government Code to guarantee the continuation of the <br />extraterritorial status and defer annexation of any portion of such 634.592 acre tract of land until <br />any type of subdivision plat or related development document is filed for any such portion of the <br />property. <br />PART 4. The City Manager is authorized to execute such development agreement if <br />accepted by Lazy Oaks Ranch L.P. <br />PART 5. This offer made by this resolution will be deemed to have been declined if <br />Lazy Oaks Ranch L.P. has not accepted the offer made by this resolution on or before September <br />16, 2014. <br />ADOPTED on September 2, 2014. <br />aniel Guerrero <br />Mayor <br />Attest: <br />
