<br /> 42 <br />Regular Meeting June 26, 1989 Page 5 <br />Mayor Morris introduced for consideration adoption of Resolution, <br />removed from consensus agenda (item llC2), the caption which was <br />read as follows: <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING THE TERMS AND CONDITIONS OF <br /> A VENDOR LICENSE AGREEMENT WITH THE SAN MARCOS LIONS <br /> CLUB, AUTHORIZING THE CITY MANAGER TO EXECUTE SAME AND- <br /> DECLARING AN EFFECTIVE DATE. <br />Mr. Moore moved to adopt the Resolution, and Mr. Guerra seconded the <br />motion. Mr. Moore moved to attach to the agreement as an Appendix 1, <br />the RFP merchandise pricing (page 3 of 5) as a part of the agreement, <br />and Mr. Guerra seconded the motion which passed unanimously. The <br />Council then voted unanimously to adopt the Resolution. <br />Mayor Morris introduced for consideration award of bid on Well Site <br />A Transmission Main Project, or consider approval to reschedule award <br />of bid to the July 10, 1989 Regular Meeting. It was the consensus <br />of the Council to move to item 13 and 14 and then return to this item. <br />Mayor Morris introduced for consideration authorization to bid Re- <br />Roofing of Police Department and Central Fire Department. Mr. Guerra <br />moved to authorize bidding and Mr. Moore seconded the motion which <br />passed unanimously. <br />Mayor Morris introduced a discussion regarding City's Ethics Review <br />Commission Ordinance and direction to staff. Mr. Guerra read into <br />the record an excerpt from the June 5, 1989 issue of City and State, <br />"Few take issue with the premise of ethics legislation: People in <br />public life shouldn't use their positions for private gain. Yet there <br />seems to be growing concern that the helter-skelter proliferation of <br />such legislation is unwieldy and confusing - and may be turning good <br />people against public service. <br />A recent blue-ribbon panel in Wisconsin, one of the pioneers in ethics <br />reform, concluded that the state's ethics laws were "overly complicated" <br />and made inadvertent criminals out of public officials who violated <br />rules that sometimes make little sense. " He stated that he would like <br />to look at the Ethics Ordinance in detail and at the Ethics Commission <br />and their duties and regulations. Mr. Guerra wondered if the ethics <br />definition changed as the commissioners changed or if the ethics de- <br />finition changed as the Council changed. He wondered about the con- <br />sistancy. Other Council members concurred. Mayor Morris directed that <br />the Ethics Review Commission go through the Ordinance and clarify the <br />ambiguities and simplify the Ordinance and prepare changes for the <br />Charter Review Commission's review if necessary and later bring their <br />findings back to the Council. Mr. Moore stated he would like the <br />Ordinance to be easily read and easily understood by lay persons. <br />Mayor Morris introduced award of bid on Well Site A Transmission Main <br />Project. Mr. Hernandez moved to award bid to Utilities Consolidated, <br />Inc., in the amount of $532,016.20 and Mr. Guerra seconded the motion <br />which passed unanimously. <br />Mayor Morris introduced an Executive Session pursusant to Article 6252- <br />17, §2(e), V.A.C.S., to discuss pending litigation (Neal vs. City) and <br />matters where the City Attorney to the City pursuant to the Code of <br />Professional Responsibility of the State Bar of Texas clearly conflicts <br />with Article 6252-17. Mr. Hernandez moved the Council adjourn into <br />Executive Session, and Mr. Moore seconded the motion which passed una- <br />nimously (10:30 p.m.). <br />Mr. Hernandez moved the Council reconvene and Mr. Guerra seconded the <br />motion which passed unanimously (11: 40 p.m.). <br />
