Morris <br /> Mayor Pro-Tern Rick Hernandez <br /> Council Members Billy G. Moore <br /> Ronald K. Hart <br /> Fred Guerra <br /> * Betty Jane Kissler <br /> Bill Plummer <br /> City Manager Larry Gilley <br /> City Secretary Janis K. vvomack <br /> City Attorney Lamar W. Hankins <br />Also Present: Jim Green, Jane Hughson, R. G. Phillips, Jenny <br />Kile, Melissa Millecam, Ron Cauble, Merry FitzPatrick, Jane <br />Wilson, Jake Sullivan, Karen Brown, June Hankins, Rachel Vasquez, <br />Patty Wenk, Myron Galchutt and others. <br />Mayor Morris called the meeting to order at 6:05 p.m. <br />Mr. Moore moved to adjourn into Executive Session pursuant to <br />Article 6252-17, Section 2(g), V.A.C.S., to discuss the <br />evaluation of a pubIc employee (Council Appointee), and Mr. <br />Hernandez seconded the motion, which passed unanimously (6:10 <br />p.m.) . <br />Mr. Hernandez moved to reconvene at 10:12 p.m. and Mr. Guerra <br />seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration the completion of the <br />evaluation/review process of Council Appointee (City Attorney) <br />and appropriate action to be taken. Mr. Guerra moved to accept <br />the resignation of Lamar Hankins and listed the terms of the <br />agreement between the City and Mr. Hankins as are defined in the <br />attached agreement and Mr. Plummer seconded the motion, \'I7hi ch <br />passed unanimously. <br />Mayor Morris introduced a discussion and consideration of <br />appropriate action regarding an agreement with the Texas <br />Department of Health and direction to Staff. Mr. Gilley stated <br />the City failed to submit a quarterly report in 1988 of <br />groundwater samples in an area of contamination at the former <br />landfill site of the City. The Health Department levied a fine <br />of $10,000.00. The City objected to the amount of the fine and <br />met with the Texas Department of Health who agreed to reduce the <br />fine to $1,000.00 for the City's failure to submit the report and <br />directed additional testing be performed. The Engineering <br />Department has prepared requests for proposals that will cost an <br />estimated $20,000.00 for the study. TDH wants the City to have <br />this study in place by October I, 1989. Mr. Gilley stated the <br />failure of the City to submit our quarterly report was due to the <br />loss of the Engineering Department's two environmental <br />technicians. Mr. Gilley also stated the City has the option of <br />requesting a formal hearing in lieu of paying the fine. Mr. <br />Plummer moved to approve the payment of the fine of $1,000.00 and <br />Mr. Hernandez seconded the motion, which passed unanimously. <br />The meeting adjourned at 10:28 p.m. on motion made by Mr. Plummer <br />and seconded by Mr. Hernandez. <br /> ~ ~r'i~ <br /> Mayor <br />* Ms. Kissler was not present at this meeting. <br />
