Mayor of San Marcos , t- City of-~' 630 East Hopkins ,,~~~v. øJt~ San Marcos, Texas 78666 Subj ec t: Solid Waste - Caldwell County City of San Marcos - Permit No. 640 v1i\~r Within the Gary Job Corps Training Center, 1.0 Mile SE of SH-21, 1. 6 Miles SW of FM-1966 ~ Dear Mayor Morris: This is to document the meeting held in this office on May 1, 1989, to discuss the Department's plans to seek administrative penalties for failure of the City of San Marcos to comply with certain requirements of the "Municipal Solid Waste Management Regulations" (MSWMR) and the subject permit's special provisions in the operation of the referenced landfill. Enclosed is a copy of a list of those who, participated in the referenced meeting. The meeting centered around the Department's letter and "Draft Report of Administrative Penalty" to the City of San Marcos dated March 29, 1989. In discussing the penalty amount, the Uepartment considered the history of previous violations, the efforts to correct the violations, proposed corrective action requirements, and the ability of the City of San Marcos , to pay. ~At the conclusion of the meeting, the Department proposed to issue an " ¡Agreed Penalty/Corrective Action Report. That proposed agreement has been ~,prepared and is enclosed. ~/ If you concur, please sign the enclosed agreement and return; t T.ri tnj,,¡¡ , 20 da s after recei t of this letter. If you decide not to agree or don't return the agreement within tea otted time, the Department will issue a Preliminary Report of Administrative Penalty on this matter. The Preliminary Report will give you the opportunity to request a formal hearing. Should you provide your consent, a formal assessment and request for payment of the penalty will follow.
