83 Regular Meeting July 24, 1989 Page 4 Mayor Morris introduced for consideration approval to accept the resignation of Acting City Attorney, Gayle Grassle. Mr. Guerra moved to accept the resignation and Mayor Morris seconded the motion, which passed unanimously. Mayor Morris introduced a discussion of the Guadalupe-Blanco River Authority filing of District and Federal lawsuits regarding the Edwards Aquifer water use and endangered species and direction to Staff. Harry Bishop of the Edwards Underground Water District stated they would support the GBRA suit and that the Directors from Hays County will support the GBRA suit. He is hopeful San Marcos will support the suit. Dr. Glen Longley stated he feels Hays and Comal Counties have the most to lose and litigation is the only remaining alternative to ascertain whether or not the State has the right to control the management of water. He stated San Marcos' support does not have to be financial but is hopeful the City will become an intervenor in the suit alongside GBRA. Mayor Morris stated she wants to have an amendment to our existing water conservation plan to make the level 625' (current 612'). The Council will bring this matter back to the table for further discussion following the Executive Session. Mr. Hernandez moved the Council adjourn into Executive Session pursuant to Article 6252-17, Sections 2(e), (f) and ( g), V.A.C.S., to discuss pending litigation (GBRA suit; Neal, Et Al vs. City), matters of the duties of the City Attorney to the City pursuant to the Code of Professional Responsibility of the State Bar of Texas clearly conflicts with Article 6252-17; purchase of real property; and employment and duties of public employees (City Attorney, Municipal Court Prosecutor, City Secretary); respectively, and Mr. Plummer seconded the motion, which passed unanimously (9:04 p.m.). Ms. Kissler moved the Council reconvene at 10:55 p.m. and Mr. Plummer seconded the motion, which passed unanimously. The City Council brought to the table for further discussion the GBRA lawsuits. Staff was directed to prepare a Resolution of support for the GBRA lawsuits. The City Manager was directed to talk with an attorney regarding the GBRA suits and making arrangements for the City's intervention.
