<br />83 <br />Regular Meeting July 24, 1989 Page 4 <br />Mayor Morris introduced for consideration approval to accept the <br />resignation of Acting City Attorney, Gayle Grassle. Mr. Guerra <br />moved to accept the resignation and Mayor Morris seconded the <br />motion, which passed unanimously. <br />Mayor Morris introduced a discussion of the Guadalupe-Blanco <br />River Authority filing of District and Federal lawsuits regarding <br />the Edwards Aquifer water use and endangered species and <br />direction to Staff. Harry Bishop of the Edwards Underground <br />Water District stated they would support the GBRA suit and that <br />the Directors from Hays County will support the GBRA suit. He is <br />hopeful San Marcos will support the suit. Dr. Glen Longley <br />stated he feels Hays and Comal Counties have the most to lose <br />and litigation is the only remaining alternative to ascertain <br />whether or not the State has the right to control the management <br />of water. He stated San Marcos' support does not have to be <br />financial but is hopeful the City will become an intervenor in <br />the suit alongside GBRA. Mayor Morris stated she wants to have <br />an amendment to our existing water conservation plan to make the <br />level 625' (current 612'). The Council will bring this matter <br />back to the table for further discussion following the Executive <br />Session. <br />Mr. Hernandez moved the Council adjourn into Executive Session <br />pursuant to Article 6252-17, Sections 2(e), (f) and ( g), <br />V.A.C.S., to discuss pending litigation (GBRA suit; Neal, Et Al <br />vs. City), matters of the duties of the City Attorney to the City <br />pursuant to the Code of Professional Responsibility of the State <br />Bar of Texas clearly conflicts with Article 6252-17; purchase of <br />real property; and employment and duties of public employees <br />(City Attorney, Municipal Court Prosecutor, City Secretary); <br />respectively, and Mr. Plummer seconded the motion, which passed <br />unanimously (9:04 p.m.). <br />Ms. Kissler moved the Council reconvene at 10:55 p.m. and Mr. <br />Plummer seconded the motion, which passed unanimously. <br />The City Council brought to the table for further discussion the <br />GBRA lawsuits. Staff was directed to prepare a Resolution of <br />support for the GBRA lawsuits. The City Manager was directed to <br />talk with an attorney regarding the GBRA suits and making <br />arrangements for the City's intervention. <br />The meeting adjourned at 11:07 p.m. on motion made by Mr. <br />Hernandez and seconded by Mr. Plummer. <br /> ~M.~ <br /> athy .
