ORDINANCE NO. 2014 -51 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS DESIGNATING A NO PARKING ZONE AT ALL <br />TIMES ON BOTH SIDES OF THE 100 AND 200 BLOCKS OF JACKMAN <br />STREET (FROM WEST SAN ANTONIO STREET TO CENTRE STREET) <br />AND AMENDING THE TRAFFIC REGISTER MAINTAINED UNDER <br />SECTION 82.067 OF THE SAN MARCOS CITY CODE TO REFLECT <br />SUCH DESIGNATION; AND INCLUDING PROCEDURAL <br />PROVISIONS. <br />RECITALS: <br />1. Section 82.172 of the San Marcos City Code prohibits parking on a street in a <br />manner that leaves available less than 14 feet of the width of the street for the movement of <br />vehicles. The 100 and 200 blocks of Jackman Street are approximately 18 feet in width and it is <br />necessary to post signs restricting parking on both sides of the street in this area to allow at least <br />14 feet in width for the movement of vehicles, including emergency management vehicles. <br />2. The designation of a no parking zone at all times on both sides of the 100 and 200 <br />blocks of Jackman Street (from West San Antonio Street to Centre Street) is in the interest of the <br />public health, safety and welfare. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. A no parking zone, to be in effect at all times, is hereby designated on <br />both sides of the 100 and 200 blocks of Jackman Street (from West San Antonio Street to Centre <br />Street), as depicted in Exhibit "A." <br />SECTION 2. The Traffic Register maintained under section 82.067 of the San Marcos <br />City Code is amended to reflect the no parking designation established under Section 1. <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />SECTION 5. This ordinance shall be in effect upon adoption on second reading. <br />
