4. Responsibilities of EAA. <br />The EAA states its intent to financially support Phase 1 of the Project by contributing no more <br />than $619,983 total ($506,904 for the City and $113,079 for the University) payable to the City <br />over three years. The terms and conditions under which such contributions will be made will be <br />set out in an interlocal contract to be negotiated, approved, and executed at a later date as provided <br />in Section 7.7. It is agreed to by the Parties that the EAA's financial participation in the Project <br />will satisfy the intent of Resolution and Order No. 12 -11 -673 of the Edwards Aquifer Authority <br />Board of Directors adopted on December 28, 2011. <br />5. Responsibilities of the City. <br />5.1 The City agrees to utilize funds for Phase 1 of the Project to extend the City's <br />reclaimed water system to serve the University's thermal plants and other end users, saving an <br />estimated 1,616 acre -feet (527 million gallons) annually of Aquifer groundwater when fully <br />implemented. <br />5.2 Upon completion of Phase 1 of the Project, the City further agrees to transfer a total <br />of 1,641 acre -feet (50% of the three -year projected water savings due to the expanded use of the <br />City's reclaimed water system for other end users) of permitted Edwards groundwater rights from <br />EAA Permit No. P100 -828 (HA00222) to the EAA for use in the Aquifer Storage and Recovery <br />Project ( "ASR ") of the San Antonio Water System ( "SAWS ") in support of implementation of <br />Section 5.5.1 of the EAHCP, between January 1, 2016, and December 31, 2020. Prior to June 1 <br />each year, the City agrees to determine an amount to be transferred that year based on the City's <br />demand conditions. Groundwater transferred each year in support of the ASR will not be subject <br />to any aquifer management fees for that year. The total amount of groundwater to be transferred <br />shall not exceed 1,641 acre -feet over the five -year period. <br />6. Responsibilities of the University. <br />6.1 The University agrees to utilize funds for Phase 1 of the Project to connect its <br />thermal plants to the City's reclaimed water system saving an estimated 522 acre -feet (170 million <br />gallons) annually of Aquifer groundwater. <br />6.2 Upon completion of Phase 1 of the Project, the University further agrees to transfer <br />a total of 366 acre -feet of permitted Edwards groundwater rights from EAA Permit Nos. P 100 -805 <br />(HA00205), P100 -806 (HA00206), and P100 -807 (HA00207) to the EAA for use in the ASR of <br />SAWS in support of the implementation of Section 5.5.1 of the EAHCP, between January 1, 2016, <br />and December 31, 2020. Prior to June 1 each year, the University agrees to determine an amount <br />to be transferred that year based on the University's demand conditions.
