1.0 AUTHORITY <br />This Development Ordinance constitutes the rules governing subdivision and platting of property and the <br />permitting of site and subdivision construction within the unincorporated areas of Caldwell County. It is intended <br />to promote the health, safety, morals, and general welfare of the County and the safe, orderly, and healthful <br />development of the unincorporated areas, these issues being hereby declared to be worthwhile public <br />purposes and in the public interest. When in conflict with any previously enacted subdivision regulations for <br />Caldwell County, these subdivision regulations shall control. <br />The ordinances and requirements described in this and the following chapters, articles and sections, shall <br />constitute and be designated the "Caldwell County Development Ordinance" and may be so cited. This <br />ordinance regulates the development of property within the jurisdiction of Caldwell County, Texas under <br />authority set forth in the following Texas statutes: <br />A) Texas Local Government Code <br />• Chapter 232 — County Regulation of Subdivisions; <br />• Chapter 242 — Authority of Municipality and County to regulate Subdivisions In and Outside <br />Municipality's Extraterritorial Jurisdiction; <br />• Chapter 245 — Issuance of Local Permits <br />B) Texas Transportation Code <br />• Chapter 251 — General County Authority Relating to Roads and Bridges <br />• Chapter 252 — Systems of County Road Administration <br />• Chapter 253 — County Improvement of Subdivision Roads <br />• Chapter 254 — Drainage on Public Roads <br />• Chapter 255 — County Regulation of Sight Distances <br />C) This Development Ordinance has been approved by the Caldwell County Commissioners Court as a <br />means of implementing County responsibilities described in the Texas Statutes listed above and as <br />required by other statutes applicable to counties. These responsibilities mandate that Caldwell County shall <br />provide for the safety, health and welfare of the general public through its authority to: <br />1) Administer the orderly development of real property in accordance with the Texas Local Government <br />Code and other applicable regulations; <br />2) Require that roadways and drainage facilities be arranged, designed, and built in a manner consistent <br />with sound planning and engineering practices and established standards of construction; <br />3) Require that proposed development demonstrate the ability to provide adequate water and wastewater <br />service and capacity; <br />4) Protect the County's natural resources in a manner compatible with sound development goals and <br />practices; <br />
