Interlocal Agreement <br />The City of San Marcos (the "City ") and Texas State University ( "Texas State ") <br />enter into this Interlocal Agreement (the "Agreement ") under the authority of the <br />INTERLOCAL COOPERATION ACT, CHAPTER 791 OF THE TEXAS GOVERNMENT CODE, as <br />amended. <br />I. RECITALS: <br />A. Texas State is a public university located within the boundaries of the <br />City. A portion of Texas State's main campus is located adjacent to the intersection of <br />Sessom Drive and Academy Street (the "Intersection "). <br />B. The City has control of traffic and transportation, and maintains the <br />streets, sidewalks and public rights -of -way within the boundaries of the City, including <br />the Intersection. <br />C. The City has executed an agreement with HDR Engineering, Inc. (the <br />"Engineer ") to prepare the City's Transportation Master Plan. <br />D. Both parties are affected by traffic at the Intersection and the area <br />surrounding the Intersection and Texas State wishes to assist the City in funding a <br />traffic impact analysis study for the Intersection to be added to the Engineer's scope of <br />work under said agreement. <br />E. For the reasons above, the parties enter into this Agreement under the <br />terms and conditions below. <br />II. TRAFFIC STUDY AND COST PARTICIPATION OBLIGATIONS <br />A. Traffic Study. The City will execute an amendment or change in services <br />to the agreement with the Engineer for the City's Transportation Master Plan that adds a <br />traffic impact analysis to the Engineer's scope of services for an estimated cost of <br />$26,563.00. The scope of work for the traffic impact analysis shall be as provided in <br />Exhibit 'A" attached hereto and made a part hereof for all purposes. <br />B. Payment. The City will pay the Engineer for the cost of such services in <br />accordance with the payment terms under the agreement with the Engineer. Upon <br />payment to the Engineer for the cost of the traffic impact analysis, the City may submit <br />an invoice to Texas State in the amount of the payment to the Engineer, together with <br />proof of payment. Texas State shall pay the amount of the invoice up to $26,563.00 for <br />the scope of work in Exhibit `A' within 30 days after its receipt of the invoice. <br />
