Interlocal Agreement The City of San Marcos (the "City ") and Texas State University ( "Texas State ") enter into this Interlocal Agreement (the "Agreement ") under the authority of the INTERLOCAL COOPERATION ACT, CHAPTER 791 OF THE TEXAS GOVERNMENT CODE, as amended. I. RECITALS: A. Texas State is a public university located within the boundaries of the City. A portion of Texas State's main campus is located adjacent to the intersection of Sessom Drive and Academy Street (the "Intersection "). B. The City has control of traffic and transportation, and maintains the streets, sidewalks and public rights -of -way within the boundaries of the City, including the Intersection. C. The City has executed an agreement with HDR Engineering, Inc. (the "Engineer ") to prepare the City's Transportation Master Plan. D. Both parties are affected by traffic at the Intersection and the area surrounding the Intersection and Texas State wishes to assist the City in funding a traffic impact analysis study for the Intersection to be added to the Engineer's scope of work under said agreement. E. For the reasons above, the parties enter into this Agreement under the terms and conditions below. II. TRAFFIC STUDY AND COST PARTICIPATION OBLIGATIONS A. Traffic Study. The City will execute an amendment or change in services to the agreement with the Engineer for the City's Transportation Master Plan that adds a traffic impact analysis to the Engineer's scope of services for an estimated cost of $26,563.00. The scope of work for the traffic impact analysis shall be as provided in Exhibit 'A" attached hereto and made a part hereof for all purposes. B. Payment. The City will pay the Engineer for the cost of such services in accordance with the payment terms under the agreement with the Engineer. Upon payment to the Engineer for the cost of the traffic impact analysis, the City may submit an invoice to Texas State in the amount of the payment to the Engineer, together with proof of payment. Texas State shall pay the amount of the invoice up to $26,563.00 for the scope of work in Exhibit `A' within 30 days after its receipt of the invoice.
