Regular Meeting June 19, 2007 Page 11 <br />Mayor Narvaiz introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS <br />APPROVING THE RELEASE AND CONVEYANCE OF A WATER LINE EASEMENT ACROSS <br />PROPERTY LOCATED IN THE CENTER POINT COURT SUBDIVISION; AUTHORIZING <br />THE CITY MANAGER TO EXECUTE THE RELEASE AND CONVEYANCE; AND DECLARING <br />AN EFFECTIVE DATE. <br />Mr. Guerrero moved for approval of Ordinance on first reading, and Ms. <br />Couch seconded the motion, which passed unanimously. <br />Mayor Narvaiz introduced for consideration removal from the table and <br />approval of an Ordinance on first reading, the caption which was read as <br />follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS <br />ESTABLISHING A FRANCHISE AGREEMENT BETWEEN THE CITY OF SAN MARCOS AND <br />CENTERPOINT ENERGY RESOURCES CORP., DBA CENTERPOINT ENERGY TEXAS GAS <br />OPERATIONS., ITS SUCCESSORS AND ASSIGNS, THE RIGHT, PRIVILEGE AND <br />FRANCHISE FOR A PERIOD OF FIVE(5)YEARS FOR THE CONSTRUCTION, <br />MAINTENANCE AND OPERATION OF NATURAL GAS DISTRIBUTION SYSTEM IN THE <br />CITY OF SAN MARCOS, HAYS COUNTY, TEXAS; PROVIDING CONDITIONS <br />CONTROLLING THE USE BY CENTERPOINT ENERGY RESOURCES CORP. DBA <br />CENTERPOINT ENERGY TEXAS GAS OPERATIONS OF PUBLIC PROPERTY <br />ESTABLISHING STANDARDS OF SERVICE; PROVIDING FOR PAYMENT OF FRANCHISE <br />FEES BY CENTERPOINT ENERGY RESOURCES CORP., DBA CENTERPOINT ENERGY <br />TEXAS GAS OPERATIONS TO THE CITY; PROVIDING FOR ACCEPTANCE; PROVIDING <br />FOR SEVERABILITY; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND <br />DECLARINGAN EFFECTIVE DATE. <br />Mr. Guerrero moved to remove the Ordinance from the table and Mr. Jones <br />seconded the motion, which passed unanimously. Mr. Bose moved for <br />approval of the Ordinance on first reading, and Mr. Jones seconded the <br />motion. Mr. O'Leary stated the new manager took a DVD of the last meeting <br />when this item was discussed to their regional meeting. He stated since <br />then there has been a new customer service standard. Mayor Narvaiz stated <br />the manager heard us loud and clear and they are working on revamping their <br />call center. She stated Centerpoint Energy does have a relationship with <br />HEB to accept payment. Mr. Bose inquired to the third paragraph of the <br />agreement. Mr. Quittner stated the third paragraph means it is $40,000.00 <br />per quarter or 30 of gross receipts.
