Regular Meeting June 19, 2007 Page 11 Mayor Narvaiz introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING THE RELEASE AND CONVEYANCE OF A WATER LINE EASEMENT ACROSS PROPERTY LOCATED IN THE CENTER POINT COURT SUBDIVISION; AUTHORIZING THE CITY MANAGER TO EXECUTE THE RELEASE AND CONVEYANCE; AND DECLARING AN EFFECTIVE DATE. Mr. Guerrero moved for approval of Ordinance on first reading, and Ms. Couch seconded the motion, which passed unanimously. Mayor Narvaiz introduced for consideration removal from the table and approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS ESTABLISHING A FRANCHISE AGREEMENT BETWEEN THE CITY OF SAN MARCOS AND CENTERPOINT ENERGY RESOURCES CORP., DBA CENTERPOINT ENERGY TEXAS GAS OPERATIONS., ITS SUCCESSORS AND ASSIGNS, THE RIGHT, PRIVILEGE AND FRANCHISE FOR A PERIOD OF FIVE(5)YEARS FOR THE CONSTRUCTION, MAINTENANCE AND OPERATION OF NATURAL GAS DISTRIBUTION SYSTEM IN THE CITY OF SAN MARCOS, HAYS COUNTY, TEXAS; PROVIDING CONDITIONS CONTROLLING THE USE BY CENTERPOINT ENERGY RESOURCES CORP. DBA CENTERPOINT ENERGY TEXAS GAS OPERATIONS OF PUBLIC PROPERTY ESTABLISHING STANDARDS OF SERVICE; PROVIDING FOR PAYMENT OF FRANCHISE FEES BY CENTERPOINT ENERGY RESOURCES CORP., DBA CENTERPOINT ENERGY TEXAS GAS OPERATIONS TO THE CITY; PROVIDING FOR ACCEPTANCE; PROVIDING FOR SEVERABILITY; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARINGAN EFFECTIVE DATE. Mr. Guerrero moved to remove the Ordinance from the table and Mr. Jones seconded the motion, which passed unanimously. Mr. Bose moved for approval of the Ordinance on first reading, and Mr. Jones seconded the motion. Mr. O'Leary stated the new manager took a DVD of the last meeting when this item was discussed to their regional meeting. He stated since then there has been a new customer service standard. Mayor Narvaiz stated the manager heard us loud and clear and they are working on revamping their call center. She stated Centerpoint Energy does have a relationship with HEB to accept payment. Mr. Bose inquired to the third paragraph of the agreement. Mr. Quittner stated the third paragraph means it is $40,000.00 per quarter or 30 of gross receipts. The Council then voted unanimously for approval of the Ordinance on first reading.
