Regular Meeting February 6, 2007 Page 8 <br />on southbound IH -35 for McCarty Lane. The reversal will allow better access <br />from IH -35 to the proposed retail development. He stated the new exit ramp <br />will be located further north, at the existing entrance ramp near Thermon, <br />and the new entrance ramp will be moved south to the existing exit ramp <br />location. He also stated TxDOT considers this ramp configuration to be <br />much safer because crossing movements between exiting and entering traffic <br />occurs on the lower speed frontage road rather than on the interstate. <br />Andy Quittner, Interim City Attorney, stated this agreement states <br />Creekside Square Limited committed to pay 1000 of the project. He also <br />stated the development agreement is required because TxDOT cannot enter <br />into funding agreements with a private development. Mr. Thomaides <br />inquired as to whether this project will take place if the developer <br />defaults. Mr. Quittner stated that the funding for the project has to be <br />paid in full before the project will begin. Mayor Narvaiz inquired to <br />whether the City would be held accountable if the project comes in higher <br />than previously thought. Mr. Quittner stated the City would be held <br />accountable. Mr. O'Leary stated the City would then hold the developers <br />accountable. Mayor Narvaiz inquired as to whether this reversal of the <br />entrance and exit ramp will benefit everyone. Mr. O'Leary stated the <br />reversal of the entrance and exit ramp will be better for everyone. The <br />Council then voted unanimously for the adoption of the Resolution. <br />Mayor Narvaiz introduced for consideration Item 16, removed from the <br />Consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE EXTENSION OF A CONTRACT WITH TECHLINE, LTD. FOR THE <br />PROVISION OF SINGLE PHASE PAD MOUNTED TRANSFORMERS; AUTHORIZING THE <br />PURCHASING MANAGER TO EXECUTE THE APPROPRIATE DOCUMENTS RELATED TO <br />THIS CONTRACT EXTENSION ON BEHALF OF THE CITY AND DECLARING AN <br />EFFECTIVE DATE. <br />Mr. Guerrero moved for adoption of the Resolution, and Mr. Thomaides <br />seconded the motion. Mr. Bose inquired as to whether the new business or <br />homeowners pay for the transformers. Mr. O'Leary stated the charge is <br />reflected in the cost. Bob Higgs, Director of Electric Utility, stated if <br />the application is standard then there is no charge, but if there is a <br />special request, then they pay the difference. The Council then voted <br />unanimously for the adoption of the Resolution. <br />Mayor Narvaiz introduced <br />Consent agenda, adoption <br />follows: <br />A RESOLUTION OF THE <br />APPROVING THE PURCH; <br />UTILITY DEPARTMENT, <br />THROUGH THE TARRANT <br />for consideration Item 18, removed from the <br />of a Resolution, the caption which was read as <br />CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />%SE OF TWO 2007 FORD F150 TRUCKS FOR THE ELECTRIC <br />METER OPERATIONS DIVISION, FROM PLANET FORD 6 <br />COUNTY COOPERATIVE PURCHASING PROGRAM; AUTHORIZING <br />
