<br />34 <br /> <br /> <br /> <br /> <br />Regular Meeting October 9, 1989 Page 8 <br /> <br /> <br />Mayor Morris introduced for consideration Item 7.B. (1) removed <br />from the consensus agenda, approval of an Ordinance on second <br />reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 18-7 OF ARTICLE I OF CHAPTER 18, <br />PARKS AND RECREATION, TO DELETE A PROVISION FOR ALLOWING <br />CARNIVALS AND CIRCUSES ON CITY PROPERTY, INCREASING USER <br />FEES FOR PARKS AND RECREATIONAL FACILITIES, AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mr. Hernandez moved for approval of the Ordinance on second <br />reading and Mr. Moore seconded the motion. Mr. Hernandez stated <br />there were some citizens expressing concern regarding the <br />doubling of the softball fields fees. Pat Crabtree stated he is <br />the owner of Crabtree Amusements and runs many carnivals for <br />non-profit organizations. He stated he had not had problems <br />meeting insurance requirements, stated he thought carnivals would <br />want to repair any ruts they make, would want to address any <br />traffic concerns for the safety of persons crossing the road and <br />whatever requirements need to be met rather than discontinuing <br />having carnivals. Mr. Guerra moved to delete Section 1 from the <br />Ordinancce to direct Staff to provide wording to address the <br />traffic concerns, etc. of carnivals. There was no second. The <br />City Council requested guidelines required for holding carnivals <br />and a copy of the City's contract be provided at the next <br />reading. The Council voted unanimously for approval of the <br />Ordinance on second reading. <br /> <br />Mayor Morris introduced for consideration Agenda Item 7.d. (4) <br />removed from the consensus agenda, adoption of a Resolution, the <br />caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, DETERMINING THAT CERTAIN ORIGINAL MUNICIPAL COURT, <br />FINANCE DEPARTMENT AND PERSONNEL DEPARTMENT RECORDS OF SAID <br />CITY ARE WORTHLESS, DIRECTING THE CITY MANAGER TO DISPOSE OF <br />SUCH RECORDS IN A MANNER CALCULATED TO DESTROY THEM IN THEIR <br />ENTIRETY, AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Hart moved for adoption of the Resolution and Ms. Kissler <br />seconded the motion. Ms. Kissler asked if the personnel records <br />were microfilmed, and Mr. Gilley responded some of the records <br />are. The Council voted unanimously for adoption of the <br />Resolution. <br /> <br />Mayor Morris introduced for consideration Agenda Item 7.D. (6) <br />removed from the consensus agenda, adoption of a Resolution, the <br />caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING AN AGREEMENT BETWEEN SAID CITY AND <br />RIVERWOOD PROFESSIONAL CENTER FOR AN EMPLOYEE ASSISTANCE <br />PROGRAM; AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT; <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for adoption of the Resolution and Mr. Guerra <br />seconded the motion. The Council asked if funds were in the <br />budget, to which Mr. Gilley responded they are. The Council <br />voted unanimously for adoption of the Resolution. <br /> <br />Mayor Morris introduced for consideration award of bid for the <br />Northeast IH35 Waterline Extension Project. Mr. Gilley advised <br />the Council seven easements are required which were not all in <br />place. He stated only one is a significant problem, and Steve <br />Kosub had advised him the negotiations with the owner's attorneys <br />were not working out. Mr. Gilley requested the Council delay <br />award of bid until the problems of the easements were worked out, <br />and that he and Jim Byrn were working on alternative solutions. <br />
