<br />61 <br />Regular Meeting October 23, 1989 Page 2 <br />Mayor Morris opened the public hearing and asked if anyone wished <br />to speak for or against the franchise agreement. Britt Meyers, <br />President of the Lions Club, was present to answer any questions <br />the Council might have and to request the Council's approval of <br />the agreement. No one else wished to speak for or against the <br />agreement, so Mayor Morris closed the public hearing. Mr. Moore <br />moved to approve the Ordinance on first reading and Mr. Hernandez <br />seconded the motion, which passed unanimously. <br />Mayor Morris introduced a public hearing and approval of an <br />Ordinance on first reading, the caption which was not read into <br />the record, but which reads as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, APPROVING THE TRANSFER OF THE EXISTING CABLE <br /> TELEVISION FRANCHISE FROM KARNACK CORPORATION TO MISSION <br /> CABLE COMPANY; PROVIDING THAT THIS TRANSFER SHALL BE SUBJECT <br /> TO ALL EXISTING TERMS OF THE CABLE TELEVISION FRANCHISE; <br /> PROVIDING FOR WRITTEN ACCEPTANCE TO BE FILED BY MISSION <br /> CABLE COMPANY, L.P.; AND PROVIDING AN EFFECTIVE DATE. <br />Mayor Morris moved to table the Ordinance and Mr. Guerra seconded <br />the motion, which passed unanimously. The public hearing was not <br />held and will be rescheduled when the Ordinance is considered. <br />Mayor Morris introduced for consideration adoption of an <br />Ordinance on third and final reading, the caption which was read <br />as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING SECTION 18-7 OF ARTICLE I OF CHAPTER 18, <br /> PARKS AND RECREATION, TO DELETE A PROVISION FOR ALLOWING <br /> CARNIVALS AND CIRCUSES ON CITY PROPERTY, INCREASING USER <br /> FEES FOR PARKS AND RECREATIONAL FACILITIES AND DECLARING AN <br /> EFFECTIVE DATE. <br />Ms. Kissler moved for adoption of the Ordinance on third and <br />final reading and Mr. Guerra seconded the motion. Rodney Cobb <br />stated the Parks Board met and discussed carnivals on City <br />property. Mr. Crabtree of Crabtree Amusements was present at the <br />meeting. Parking, site repairs, liability insurance (with the <br />policy including the City as an additional insured) were <br />discussed. The Parks Board will devise a site plan with on-site <br />parking and if citizens are crossing the roadway for additional <br />parking or during bad weather, security will be provided to <br />assist crossing. Mr. Hernandez moved the Ordinance be amended to <br />change the suggested fee of $50.00 for softball fields to $40.00 <br />and Ms. Kissler seconded the motion, which passed unanimously. <br />Mr. Plummer moved to amend the Ordinance to delete SECTION 1. ( " . <br />. . allowing carnivals and circuses on City property is <br />deleted.") and Ms. Kissler seconded the motion, which passed <br />unanimously. The Mayor requested the Parks Board review the <br />parking, liability insurance and maintenance regarding carnivals <br />in a year and report to the Council. The Council then voted <br />unanimously for adoption of the Ordinance on third and final <br />reading. <br />Mayor Morris introduced for consideration adoption of a <br />Resolution, the caption which was read as follows: <br /> A RESOLUTION AUTHORIZING SUBMISSION OF A COMPLETED BALLOT TO <br /> THE NATIONAL LEAGUE OF CITIES PERTAINING TO PROPOSED <br /> AMENDMENTS TO THE BYLAWS OF THAT ORGANIZATION; AND DECLARING <br /> AN EFFECTIVE DATE. <br />Ms. Kissler moved for adoption of the Resolution and Mr. Guerra <br />seconded the motion. Ms. Kissler moved to amend PART 1. to <br />complete the Council's positions for A., B., C. and D. as "Yes", <br />and Mr. Plummer seconded the motion, which passed unanimously. <br />The Council then voted unanimously for adoption of the <br />Resolution. <br />
