<br />I <br /> <br />I <br /> <br />- <br /> <br />2. Purposes o~ the P.U.D.: In certain instances the purposes of this <br />ordinance may be achieved by the development of planned units which do <br />not conform in all respects with the land use pattern designated on <br />the zoning map, the district regulations prescribed by the zoning <br />ordinance, or the subdivision requirements of this ordinance. A <br />planned unit development (P.U.D.) may include a combination of dif- <br />ferent dwelling types and/or a variety of land uses which creatively <br />complement each other and harmonize with existing and proposed land <br />uses in the vicinity. In order to encourage creative development of <br />the land, provide locations for well-planned comprehensive developments. <br />and provide for variety in the development pattern of the City of San <br />Marcos which conform with the purposes of the master plan, the Planning <br />and Zoning Commission is empowered to grant permits for planned unit <br />developments, subject to review and approval by the City Council. - <br />Technical planning review of these planned unit developments should be <br />provided by the Director of Planning. <br /> <br />3. Location permit required: A planned unit development may be located <br />in any district upon the granting of a permit in accordance with the <br />provisions of this section, the Zoning Ordinance, and all other adopted <br />ordinances. <br /> <br />4. Minimum site area: The minimum site area for a planned unit develop- <br />ment shall be five (5) acres. <br /> <br />5. Permit procedure for P.U.D.: The regulations prescribed herein shall <br />regulate the procedure for making application for a permit for a <br />planned unit development, the public hearing, the staff investigation <br />and technical report, the action by the planning and zoning commission, <br />the planning director, the appeal to or review by the City Council, <br />and the lapse or revocation of a permit, and shall regulate new appli- <br />cations and permits to run with the land, subject to the following <br />prerequisites. <br /> <br />6. Development plan; tabulation of average population density: The <br />application shall be accompanied by a development plan of the entire <br />planned unit development, drawn at a scale of one hundred (100) feet <br />to one inch, and showing provisions for drainage of surface water, <br />water courses, railroads and public utility rights-of-way, streets, <br />driveways, pedestrian walks, off-street parking and off-street loading <br />facilities, reservations for public uses, including parks, playgrounds <br />and other open spaces, private uses, including dwelling types; lot <br />layout, locations, land coverage and heights of structures and land- <br />scaped area. In addition to the data and drawings prescribed, the <br />application shall be accompanied by a tabulation of the average popula- <br />tion density per net acre and per gross acre in the area or areas <br />proposed to be devoted to residential use. <br /> <br />7. Granting of a permit: The Planning Commission may grant a permit for <br />a planned unit development and may vary the specific requirements of <br />this chapter, if, on the basis of the application and the evidence <br />submitted, the Planning Commission makes the following findings: <br /> <br />-30- <br />
