<br />Ordinance have been met, as certified by the Office of the <br />Director of Public Works. <br /> <br />n. <br /> <br />All parking areas and parking spaces shall be designed and <br />constructed to protect adjacent residences from the direct <br />glare of headlights of vehicles using the parking area. In <br />accordance, all off-street parking areas shall be effectively <br />screened on each side by a solid wall or fence from any <br />adjoining property zoned single-family. Such wall or fence <br />shall not be less than four (4) feet or more than six (6) <br />feet in height, shall be placed on the property line, and <br />shall be maintained in good condition without any advertising <br />thereon. The space between such wall or fence and the lot <br />line of any adjoining residential property shall be landscaped <br />with grass, hardy shrubs or evergreen ground cover. In lieu <br />of such wall or fence, a strip of land not less than ten <br />(10) feet in width and planted and maintained with an ever- <br />green hedge, or dense planting of evergreen shrubs, not less <br />than four (4) feet in height, may be substituted. <br /> <br />I <br /> <br />Pursuant to the adoption of such standards and regulations, Exhibit <br />"A-D" attached to said Ordinance and incorporated therein be, and is hereby <br />approved, enacted, and adopted. <br /> <br />SECTION 25 - LANDSCAPING AND BUFFERING <br /> <br />I <br /> <br />Any commercial or industrial use which has a side or rear contiguous <br />to any noncommercial or nonindustrial use shall be buffered as defined <br />herein. Where such commercial or industrial use is separated by only a <br />street and such commercial or industrial use side-up to or back up to the <br />use for which the buffer is required, a fence a minimum of six (6) feet in <br />height is required, except where the commercial or industrial building is <br />constructed on the property line. The screen shall be located no closer to <br />the street than the property line. Any ordinances concerning sight obstruc- <br />tions of intersections shall be applicable to the screen where it is inter- <br />sected by a street or thoroughway. <br /> <br />Prior to construction of buffers, as defined, complete plans showing <br />type of material, depth of beam, and structural support shall be submitted <br />to the building permit office for analysis to determine whether or not: <br /> <br />1. The screen will withstand the pressures of time and nature. <br /> <br />2. The screen adequately accomplishes the purpose for which it was <br />intended. <br /> <br />The Chief Building Inspector shall determine if such buffer meets the <br />requirements of this section. <br /> <br />SECTION 26 - NONCONFORMING USES <br /> <br />A. The general public, the City Council, and the Planning Board are <br />directed to take note that nonconformities in the use and development <br />of land and buildings are to be avoided, or eliminated where now <br />existing, wherever and whenever possible, EXCEPT: <br /> <br />1. <br /> <br />When necessary to preserve property rights established prior to <br />the date these regulations become effective as to the property in <br />question, and <br /> <br />I <br /> <br />2. <br /> <br />When necessary to promote the general welfare and to protect the <br />character of the surrounding property. <br /> <br />B. Nonconforming Structures <br /> <br />Where a lawful structure exists at the effective date of adoption or <br />amendment of this Ordinance that could not be built under the terms of <br />this Ordinance by reason of restrictions on area, lot coverage. height, <br />yards, its location on the lot, or other requirements concerning the <br /> <br />-45- <br />
