I I I 38 ORDINANCE 1980-43 AN ORDINANCE OF THE CITY COUNCrL OF THE CITY OF SAN MARCOS, TEXAS AMENDING CHAPTER 18, ENTITLED "PARKS AND RECREATION" OF THE CODE OF ORDINANCES OF SAID CITY TO PROHIBIT THE BRINGING OF GLASS BEVERAGE CONTAINERS IN- TO CITY PARK, RIO VISTA PARK OR LUCIO PARK OR THE POSSESSION OF SUCH CONTAINERS IN SAID PARKS; PROHIBITING THE POSSESSION OF GLASS BEVERAGE CONTAINERS IN OR ON THE SAN MARCOS RIVER WITHIN THE CORPORATE LIMITS OF SAID CITY; AND DECLARING AN EMERGENCY. WHEREAS, the safety and health of individuals using the San Marcos River and City of San Marcos parks located along the river would be enhanced by the absence of broken glass in the vicinity of the River and parks; and, WHEREAS, the presence of glass beverage containers, both broken and unbroken in the area in and adjacent to the San Marcos River detracts from the natural beauty of the area and makes im- possible the equitable and optimum use thereof; and, WHEREAS, much time and effort must be expended to clear the river area of such debris; and, WHEREAS, the Friends of the River, a citizen group interested ln protecting the San Marcos River, has requested the prohibition of glass beverage containers in areas in and around the River and, understanding that lack of city personnel will make enforcement difficult, is willing and eager to aid in providing signs and enforcement assistance in support of this prohibition; now, there- fore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the Code of Ordinances, City of San Marcos, Texas, is hereby amended by adding a section! to be numbered section 18-10, which said section reads as follows: Section 18-10. (a) It shall be unlawful for any person to bring any glass beverage container into City Park, Rio Vista Park or Lucio Park said parks being located within the corporate limits of the City of San Marcos, Texas or to possess any glass beverage container in said parks. (b) It shall be unlawful for any person to possess any glass beverage container in or on the waters of the San Marcos River within the corporate limits of the City. SECTION 2. That the importance of this ordinance creates an emergency and an imperative purpose necessary that the provisions of the charter requiring that ordinances shall be read on three separate meetings and that no ordinances shall become effective un- til the expiration of ten (10) days following the date of its final passage be suspended, and these provisions are hereby suspened, and this Ordinance shall take effect and be in full force and effect from and after its adoption and publication in a newspaper of general circulation within the City.
