<br />I <br /> <br />I <br /> <br />I <br /> <br />38 <br /> <br />ORDINANCE 1980-43 <br /> <br />AN ORDINANCE OF THE CITY COUNCrL OF THE <br />CITY OF SAN MARCOS, TEXAS AMENDING CHAPTER <br />18, ENTITLED "PARKS AND RECREATION" OF THE <br />CODE OF ORDINANCES OF SAID CITY TO PROHIBIT <br />THE BRINGING OF GLASS BEVERAGE CONTAINERS IN- <br />TO CITY PARK, RIO VISTA PARK OR LUCIO PARK <br />OR THE POSSESSION OF SUCH CONTAINERS IN SAID <br />PARKS; PROHIBITING THE POSSESSION OF GLASS <br />BEVERAGE CONTAINERS IN OR ON THE SAN MARCOS <br />RIVER WITHIN THE CORPORATE LIMITS OF SAID <br />CITY; AND DECLARING AN EMERGENCY. <br /> <br />WHEREAS, the safety and health of individuals using the San <br />Marcos River and City of San Marcos parks located along the river <br />would be enhanced by the absence of broken glass in the vicinity <br />of the River and parks; and, <br /> <br />WHEREAS, the presence of glass beverage containers, both <br />broken and unbroken in the area in and adjacent to the San Marcos <br />River detracts from the natural beauty of the area and makes im- <br />possible the equitable and optimum use thereof; and, <br /> <br />WHEREAS, much time and effort must be expended to clear the <br />river area of such debris; and, <br /> <br />WHEREAS, the Friends of the River, a citizen group interested <br />ln protecting the San Marcos River, has requested the prohibition <br />of glass beverage containers in areas in and around the River and, <br />understanding that lack of city personnel will make enforcement <br />difficult, is willing and eager to aid in providing signs and <br />enforcement assistance in support of this prohibition; now, there- <br />fore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the Code of Ordinances, City of San Marcos, <br />Texas, is hereby amended by adding a section! to be numbered section <br />18-10, which said section reads as follows: <br /> <br />Section 18-10. <br /> <br />(a) It shall be unlawful for any person to bring <br />any glass beverage container into City Park, <br />Rio Vista Park or Lucio Park said parks being <br />located within the corporate limits of the <br />City of San Marcos, Texas or to possess any <br />glass beverage container in said parks. <br /> <br />(b) It shall be unlawful for any person to possess <br />any glass beverage container in or on the waters <br />of the San Marcos River within the corporate <br />limits of the City. <br /> <br />SECTION 2.
