<br />~ <br /> <br />THE STATE OF TEXAS <br />COUNTY OF HAYS <br /> <br />x <br />X <br /> <br />RELEASE <br /> <br />I <br /> <br />WHEREAS, the City of San Marcos, Texas, is considering <br /> <br />the matter of abandoning portions of Guadalupe Street, Roanoke <br /> <br />Street, Lyndon B. Johnson Drive, Pleasant Street, Park Street <br /> <br />and an alley extending northward and then eastward from the <br /> <br />north line of Pleasant Street, near the intersection of Pleasant <br /> <br />Street and Sessom Drive as described more particurlarly in the <br /> <br /> <br />attached Exhibit A; and, <br /> <br />WHEREAS, the City has given due notice to all property <br /> <br />owners whose property abuts said portions of said streets and <br /> <br />alley being considered for abandonment; and, <br /> <br />WHEREAS, Southwest Texas State University is the owner of <br /> <br />all property abutting said portions of said streets and alley; <br /> <br /> <br />and, <br /> <br />I <br /> <br />WHEREAS, it is to the advantage of Southwest Texas State <br /> <br /> <br />University, whose property abuts said portions of said streets <br /> <br /> <br />and alley; and to the advantage of the public generally to <br /> <br /> <br />abandon said portions of said streets and alley: <br /> <br />I <br /> <br />NOW, THEREFORE, in consideration of benefits to be received <br />by Southwest Texas State University and the general public, which <br />are hereby acknowledged, Southwest Texas State University, acting <br /> <br /> <br />by and through Eugene E. Payne , its Vice President for Finance <br /> <br /> <br />and Management , does hereby fully and forever release, acquit <br /> <br /> <br />and discharge said City, its officers, successors and assigns, <br /> <br />from any and all actions, causes of action, claims and demands <br /> <br />of whatsoever kind or nature on account of the abandonment of <br /> <br />said portions of said streets and alley as described on Exhibit <br />A which is attached hereto and incorporated herein for all in- <br />tents and purposes. <br /> <br />It is expressly understood and agreed that this release lS <br />
