~ THE STATE OF TEXAS COUNTY OF HAYS x X RELEASE I WHEREAS, the City of San Marcos, Texas, is considering the matter of abandoning portions of Guadalupe Street, Roanoke Street, Lyndon B. Johnson Drive, Pleasant Street, Park Street and an alley extending northward and then eastward from the north line of Pleasant Street, near the intersection of Pleasant Street and Sessom Drive as described more particurlarly in the attached Exhibit A; and, WHEREAS, the City has given due notice to all property owners whose property abuts said portions of said streets and alley being considered for abandonment; and, WHEREAS, Southwest Texas State University is the owner of all property abutting said portions of said streets and alley; and, I WHEREAS, it is to the advantage of Southwest Texas State University, whose property abuts said portions of said streets and alley; and to the advantage of the public generally to abandon said portions of said streets and alley: I NOW, THEREFORE, in consideration of benefits to be received by Southwest Texas State University and the general public, which are hereby acknowledged, Southwest Texas State University, acting by and through Eugene E. Payne , its Vice President for Finance and Management , does hereby fully and forever release, acquit and discharge said City, its officers, successors and assigns, from any and all actions, causes of action, claims and demands of whatsoever kind or nature on account of the abandonment of said portions of said streets and alley as described on Exhibit A which is attached hereto and incorporated herein for all in- tents and purposes. It is expressly understood and agreed that this release lS
