Page 5 I AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, GRANTING TO LEAL'S RIVERSIDE TIRE SERVICE A FRANCHISE TO OPERATE AND MAINTAIN A SERVICE USING THE STREETS OF THE CITY TO TRANSPORT PERSONS USING INNERTUBES TO AND FROM THE SAN MARCOS RIVER; PRESCRIBING THE TERMS, CONDITIONS, OBLIGATIONS AND LIMITATIONS UPON WHICH THE FRANCHISE SHALL BE EXERCISED; SETTING A FEE FOR THIS FRANCHISE; DECLARING AN EMERGENCY; AND ESTABLISHING AN EFFECTIVE DATE. I Mayor Narvaiz opened the public hearing, and asked if anyone wished to speak. 1) Carlos Gonzales stated he represents Mr. Leal. He stated he is present to answer any questions. Mayor Narvaiz asked if anyone else wished to speak. No one did, so Mayor Narvaiz closed the public hearing. Mr. Bose stated the letter written by Alfredo Leal states they are securing liability insurance in the amount of $500,000.00. He inquired if $500,000.00 liability insurance was enough. Mr. Taylor stated he feels $500,000.00 is enough liability insurance. Mayor Narvaiz stated Mr. Leal is securing more liability insurance than is required by the City. Mr. Thomaides stated he is concerned with removing business from the Noon Lions Club, since they donate 100% of their profits to charitable organizations. Mr. Bose inquired whether a special license was required for a tube shuttle. Andy Quittner, Assistant City Attorney, stated the Agreement requires Mr. Leal to meet State Driver's License requirements, which is a lower level of a Commercial License. Mayor Narvaiz stated she contacted the Noon Lions Club members, who indicated they are okay with this agreement. Mr. Jones inquired whether a tube shuttle can operate without an Agreement. Mr. Taylor stated an agreement is required in order to operate on the City streets. On roll call for adoption of the Ordinance on emergency, the following vote was recorded: AYE: Guerrero, Mihalkanin, Narvaiz, Diaz, Jones and Bose. NAY: Thomaides. ABSTAIN: None. Mayor Narvaiz introduced for consideration a public hearing and approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, INCREASING THE RATE FOR COLLECTION AND DISPOSAL OF RESIDENTIAL SOLID WASTE AND RECYCLABLE MATERIALS; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EFFECTIVE DATE.
