<br />Regular Meeting <br /> <br />May 16, 2006 <br /> <br />61 . <br />Page 5 <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />GRANTING TO LEAL'S RIVERSIDE TIRE SERVICE A FRANCHISE TO OPERATE AND <br />MAINTAIN A SERVICE USING THE STREETS OF THE CITY TO TRANSPORT PERSONS <br />USING INNERTUBES TO AND FROM THE SAN MARCOS RIVER; PRESCRIBING THE <br />TERMS, CONDITIONS, OBLIGATIONS AND LIMITATIONS UPON WHICH THE <br />FRANCHISE SHALL BE EXERCISED; SETTING A FEE FOR THIS FRANCHISE; <br />DECLARING AN EMERGENCY; AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />I <br /> <br />Mayor Narvaiz opened the public hearing, and asked if anyone wished to <br />speak. 1) Carlos Gonzales stated he represents Mr. Leal. He stated he is <br />present to answer any questions. Mayor Narvaiz asked if anyone else wished <br />to speak. No one did, so Mayor Narvaiz closed the public hearing. Mr. <br />Bose stated the letter written by Alfredo Leal states they are securing <br />liability insurance in the amount of $500,000.00. He inquired if <br />$500,000.00 liability insurance was enough. Mr. Taylor stated he feels <br />$500,000.00 is enough liability insurance. Mayor Narvaiz stated Mr. Leal <br />is securing more liability insurance than is required by the City. Mr. <br />Thomaides stated he is concerned with removing business from the Noon Lions <br />Club, since they donate 100% of their profits to charitable organizations. <br />Mr. Bose inquired whether a special license was required for a tube <br />shuttle. Andy Quittner, Assistant City Attorney, stated the Agreement <br />requires Mr. Leal to meet State Driver's License requirements, which is a <br />lower level of a Commercial License. Mayor Narvaiz stated she contacted <br />the Noon Lions Club members, who indicated they are okay with this <br />agreement. Mr. Jones inquired whether a tube shuttle can operate without <br />an Agreement. Mr. Taylor stated an agreement is required in order to <br />operate on the City streets. On roll call for adoption of the Ordinance on <br />emergency, the following vote was recorded: <br /> <br />AYE: <br /> <br />Guerrero, Mihalkanin, Narvaiz, Diaz, Jones and Bose. <br /> <br />NAY: Thomaides. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Narvaiz introduced for consideration a public hearing and approval of <br />an Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />INCREASING THE RATE FOR COLLECTION AND DISPOSAL OF RESIDENTIAL SOLID <br />WASTE AND RECYCLABLE MATERIALS; INCLUDING PROCEDURAL PROVISIONS; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />I <br /> <br />Mayor Narvaiz opened the public hearing, and asked if anyone wished to <br />speak. 1) Ryan Beard, Texas Disposal Systems, stated he is present tonight <br />to answer any questions the Council might have. Mayor Narvaiz asked if <br />anyone else wished to speak. No one did, so Mayor Narvaiz closed the <br />public hearing. Mr. Jones moved for approval of the Ordinance and Mr. <br />
