<br />Regular Meeting <br /> <br />June 6, 2006 <br /> <br />84. <br />Page 5 <br /> <br />Mayor Narvaiz introduced for consideration Item 11, removed from the <br />I consent agenda, approval of an Ordinance on second reading, the caption <br />which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />INCREASING THE RATE FOR COLLECTION AND DISPOSAL OF RESIDENTIAL SOLID <br />WASTE AND Recyclable MATERIALS; INCLUDING PROCEDURAL PROVISIONS; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Thomaides moved for approval of an Ordinance on second reading, and Mr. <br />Guerrero seconded the motion. Mr. Bose stated he pulled this Ordinance <br />because of the Consumer Price Index allowance provided in the contract. On <br />roll call for approval of the Ordinance on second reading, the following <br />vote was recorded: <br /> <br />AYE: Thomaides, Guerrero, Mihalkanin, Narvaiz, Diaz and Jones. <br /> <br />NAY: Bose. <br /> <br />ABSTAIN: None. <br /> <br />I <br /> <br />Mayor Narvaiz introduced for consideration Item 14, removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE TERMS AND CONDITIONS OF AMENDMENT NUMBER TWO TO THE <br />LEASE OF AIRPORT PROPERTY BETWEEN THE CITY AND BERRY AVIATION, INC.; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDMENT; AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />I <br /> <br />Mr. Mihalkanin moved for adoption of the Resolution, and Mr. Diaz seconded <br />the motion. Mr. O'Leary stated Berry Aviation is the largest business at <br />the Municipal Airport. He stated the Council approved a lease agreement <br />with Berry Aviation on March 13, 2006, for construction of a new terminal <br />facility and hangar. He stated Berry Aviation has decided to not go <br />forward with the project in favor of upgrading and remodeling the current <br />facility. He stated if the Council approves this lease, Berry Aviation <br />will also maintain control during the term of this new contract of the <br />airport's fuel storage facility located at 1720 Airport Drive, and the 2003 <br />contract amendment for an automated fuel dispensing station. Richard <br />Mendoza, Director of Public Works, stated Berry Aviation has elected not to <br />move forward with the new terminal facility and hangar project. He stated <br />Berry Aviation is requesting a 20 year plus 10 year extension of their <br />current lease agreement due to expire in 2012. He stated with this <br />upgrade, Berry has requested an extension of their current 1992 lease <br />agreement with no provisional changes except an increase in rates from the <br />
