Section <br />11201.028 overrules the provision of Section 3.11 of the City Charter <br />requiring the reading of Ordinances on three several days and delaying <br />effectiveness until ten days after final passage unless such Ordinance lS <br />adopted as an emergency measure. Mayor Narvaiz inquired as to whether <br />State Law would prevail even if the current adoption process was not <br />changed. Mr. Taylor stated State Law would prevail over the City Charter <br />Section 3.11. Mr. Thomaides stated he feels the Council needs flexibility <br />and should consider the change. Mr. Jones stated he feels the City Charter <br />Section 3.11 has no legal binding the way it is written. Mr. Mihalkanin <br />stated he feels the public should have a chance to discuss this change. <br />Mr. Taylor stated the Council could direct the Charter Review Commission to <br />discuss this issue, provide the Council with a report and add this to the <br />ballot. Mr. O'Leary inquired as to whether to Council still wanted items <br />brought to the Council on emergency. Mayor Narvaiz stated she feels the <br />City should follow State Law. Mr. Mihalkanin stated he feels if the change <br />in the Charter is made, Staff needs to get the change out to the public. <br />The Council agreed by consensus for the proposed change to City Charter <br />Section 3.11 be taken to the Charter Review Commission for their <br />recommendation to place on the ballot. <br /> <br />Mayor Narvaiz introduced for consideration Item 10, removed from the <br />Iconsent agenda, adoption of an Ordinance on third and final reading, the <br />caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />INCREASING THE RATE FOR COLLECTION AND DISPOSAL OF RESIDENTIAL SOLID <br />WASTE AND RECYCLABLE MATERIALS; INCLUDING PROCEDURAL PROVISIONS; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Guerrero moved for adoption of the Ordinance on third and final <br />reading, and Mr. Diaz seconded the motion. Mr. Bose stated he will be <br />voting against this item. On roll call for adoption of the Ordinance on <br />third and final reading, the following vote was recorded: <br /> <br />AYE: Thomaides, Guerrero, Mihalkanin, Narvaiz, Diaz and Jones. <br /> <br />NAY: Bose. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Narvaiz introduced for consideration Item 11, removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br /> <br /> <br />I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />fOllO::JECTING THE BID SUBMITTED FOR THE SAN MARCOS MUNICIPAL IMPROVEMENTS <br /> <br />PROJECT; AND DECLARING AN EFFECTIVE DATE. <br />
