<br />Special Meeting <br /> <br />August 28, 2006 <br /> <br />Page 2 <br /> <br />vote on the proposed rate on Monday, September 11, 2006 at 6:00 p.m. <br />City Council Chambers. <br /> <br />in <br /> <br />thell <br /> <br />Mayor Narvaiz introduced a public hearing regarding an Annexation <br />Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 50.237 ACRES, MORE OR <br />LESS, LOCATED IN THE 2600 BLOCK OF POST ROAD (HILLBURN TRACT) ; <br />APPROVING A SERVICE PLAN FOR THIS TRACT; AND INCLUDING PROCEDURAL <br />PROVISIONS. <br /> <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Narvaiz closed the public hearing. <br /> <br />Mayor Narvaiz introduced an Executive Session pursuant to the Government <br />Code, Sections 551.071, to seek the City Attorney's advice regarding <br />pending litigation, contemplated litigation, a settlement offer, or a <br />matter involving attorney-client privilege (Hotel Occupancy Tax/Conference <br />Center Project). The Council adjourned into Executive Session at 6:06 p.m. <br /> <br />Mayor Narvaiz announced the Council would reconvene at 6:21 p.m. <br /> <br />Mayor Narvaiz introduced for consideration approval of an Ordinance on I <br />first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE PARTIAL RELEASE OF A WATER LINE EASEMENT LOCATED IN A <br />495 ACRE, MORE OR LESS, TRACT OF PROPERTY LOCATED NEAR THE <br />INTERSECTION OF CENTERPOINT ROAD AND OLD BASTROP ROAD; APPROVING THE <br />RELEASE OF A TAX ABATEMENT AGREEMENT WITH APACHE HILLS, LLP., RELATED <br />TO THIS PROPERTY; AUTHORIZING THE CITY MANAGER TO EXECUTE RELEASES; <br />AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Jones moved for approval of an Ordinance on first reading, and Mr. Diaz <br />seconded the motion. Mr. Mihalkanin inquired to whether the requested <br />releases of the water line easement might be needed later by the City. <br />Mayor Narvaiz stated the City will not be releasing the portion of the <br />water line easement needed by the City. She stated Staff will provide a <br />list of the easements being retained by the City. The Council then voted <br />unanimously for approval of the Ordinance on first reading. <br /> <br />Mayor Narvaiz introduced for consideration adoption of an Ordinance on <br />emergency the caption which was read as follows: <br /> <br />AMENDING THE ORDINANCE ADOPTED ON AUGUST 15, 2006, ORDERING A GENERAL <br />AND SPECIAL ELECTION TO BE HELD ON NOVEMBER 7, 2006, TO COMBINE THE <br />POLLING PLACES FOR PRECINCTS 120 AND 121; AND DECLARING AN EMERGENCY. <br /> <br />II <br />
