Special Meeting August 28, 2006 Page 2 vote on the proposed rate on Monday, September 11, 2006 at 6:00 p.m. City Council Chambers. in thell Mayor Narvaiz introduced a public hearing regarding an Annexation Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 50.237 ACRES, MORE OR LESS, LOCATED IN THE 2600 BLOCK OF POST ROAD (HILLBURN TRACT) ; APPROVING A SERVICE PLAN FOR THIS TRACT; AND INCLUDING PROCEDURAL PROVISIONS. Mayor Narvaiz opened the public hearing and asked if anyone wished to speak. No one did, so Mayor Narvaiz closed the public hearing. Mayor Narvaiz introduced an Executive Session pursuant to the Government Code, Sections 551.071, to seek the City Attorney's advice regarding pending litigation, contemplated litigation, a settlement offer, or a matter involving attorney-client privilege (Hotel Occupancy Tax/Conference Center Project). The Council adjourned into Executive Session at 6:06 p.m. Mayor Narvaiz announced the Council would reconvene at 6:21 p.m. Mayor Narvaiz introduced for consideration approval of an Ordinance on I first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE PARTIAL RELEASE OF A WATER LINE EASEMENT LOCATED IN A 495 ACRE, MORE OR LESS, TRACT OF PROPERTY LOCATED NEAR THE INTERSECTION OF CENTERPOINT ROAD AND OLD BASTROP ROAD; APPROVING THE RELEASE OF A TAX ABATEMENT AGREEMENT WITH APACHE HILLS, LLP., RELATED TO THIS PROPERTY; AUTHORIZING THE CITY MANAGER TO EXECUTE RELEASES; AND PROVIDING AN EFFECTIVE DATE. Mr. Jones moved for approval of an Ordinance on first reading, and Mr. Diaz seconded the motion. Mr. Mihalkanin inquired to whether the requested releases of the water line easement might be needed later by the City. Mayor Narvaiz stated the City will not be releasing the portion of the water line easement needed by the City. She stated Staff will provide a list of the easements being retained by the City. The Council then voted unanimously for approval of the Ordinance on first reading. Mayor Narvaiz introduced for consideration adoption of an Ordinance on emergency the caption which was read as follows: AMENDING THE ORDINANCE ADOPTED ON AUGUST 15, 2006, ORDERING A GENERAL AND SPECIAL ELECTION TO BE HELD ON NOVEMBER 7, 2006, TO COMBINE THE POLLING PLACES FOR PRECINCTS 120 AND 121; AND DECLARING AN EMERGENCY.
